Dear Chairman Deale:

The purpose of this le'_cer is to clarify SCANP's understanding of the miscellaneous orders regarding the schedule applicable to submission of proposed findings of fact and conclusions of law, briefs and a proposed form of order or decision, dated September 13, 1979. Our interpretation of the order is that all of our sub-missions would be due on the same date, October 12, 1979. While we presently anticipate that SCANP will be able to comply with the October 12th deadline, we do wish to note : hat because i

applicants have failed to file conclusions of law, a brief, or a proposed form of order, we shall at this time also confine our filing to proposed findings of fact.

In submitting its proposed findings, applicants " reserved" the opportunity to file conclusions of law, briefs, and a propcsed fo:= of order or decision until after evidentiary sessions re-garding subjects to be covered in the findings are concluded.

We therefore invoke a similar reservation. The Staff and applicants have infor=ed us that they do not obj ect to our pro-posa to file proposed findings of fact on October 12.
