(Allens Creek Nuclear Generating S Station, Unit 1) 5 APPLICANT'S RESPONSE TO ADDITIONAL CONTENTIONS OF NANCY L. DrAHAM Applicant is in receipt of a letter from Petitioner Nancy L. Durham dated September 27, 1979, containing additions to the contentions listed in her July 9, 1979 filing. In its August 6, 1979 Order, the Board set September 14, 1979 as the deadline for the filing of contentions. These contentions are, therefore, non-timely and Petitioner does not attempt to satisfy the Commission's regulations in 10 CFR S 2.714(a) concerning late-filed petitions.

Petitioner contends that building the ACNGS cooling lake will increase the danger of flooding in the vicinity of her home. This potential environmental effect was considered in the. Partial Initial Decision, and a finding made that construction of ACNGS would not have a significant effect on flood levels and frequency in the Brazos River floodplain.

or a material change in circumstances, relitigation of issues decided in the PID is prohibited. ALAB-525 at 15-16. Peti-tioner has alleged neither of the above.

Petitioner also makes vague references to population growth and transportation problems in the final paragraph of her letter. The statements in this paragraph do not constitute litigable issues of fact. In any case., demography was fully considered in the PID, 55 81-82, and the Petitioner offers no basis whatsoever for overturning the determination made therein. Similarly, Petitioner's vague reference to " dangerous materials in transit" does not begin to approach the showing of "special circumstances" required pursuant to 10 CFR S 2.758 to challenge the Commission's regulations concerning emissions during transportation. 10 CFR S 51.20(g) and Table S-4.

This Board has already rejected a similarly vague contention involving waste transportation. (Feb. 9 Order, at 43).

For all of the foregoing reasons, the Board should dismiss the additional contentions filed by Nancy L. Durham.
