In the matter of Pacific Gas and Electric Company (Humboldt Bay Power Plant, Unit #3)
Docket No: 50-133, License No: DPR-7
Dear Mr. Luton:
By your Order dated January 11, 1979 you directed the licensing and the regulatory staff to submit their written responses to any of the filed contentions which they believe should not be admitted as issues in this proceeding.
Their responses were to be made no later than February 2, 1979 and a pre-hearing conference was to be scheduled thereafter.
In response to your Order, Pacific Gas and Electric Company filed a motion to hold the proceedings in abeyance which was opposed by inter-venors.
Thereafter, on May 7, 1979 an order issued holding further proceedings in abeyance until October 1, 1979.
In addition, the licensee was instructed to furnish to the Board and parties reports in reasonable detail as to the current status of its investigations.
The second part of this order has been in large part ignored by the licensee.
At this time the intervenors request that this matter be set for a pre-trial conference as soon as possible after October 1, 1979.
We believe that this is in the best interest of all parties.
