Dear Members of the Board:
At the special prehearing conference, the Board rsquested that the parties advise the Board in writing of their positions regarding Contention 9.
As the farm census data in question had not been received by the 13th of Sep-tember, one of Applicu.c's attorneys contacted Mr. Bock, counsel for Neiner Far. :.
Mr. Bock informed Applicant's attorney that after having reviewed the farm census data it is apparent that the data used by Applicant in its analysis is the most current data available, and therefore, Neiner Farms will voluntarily withdraw Contention 9 from this proceeding.
