REPORT OF THE DEPARTMENT OF JUSTICE - AUGUST, 1979 Pursuant to the Order dated June 21, 1978, issued by the Atomic Safety and Licensing Board (" Board"), the Department of Justice (" Depart. ment") submits this report on the progress made f.n completing discovery during the month of August, 1979.

During the month of August, the Department was primarily involved with the taking of depositions. In conjunction with the NRC staff, the Department deposed Messrs. Raymond, Lytle, Swinke, Hatcher and Robuck. The Department also participated in the depositions jointly taken by Houston Lighting & Power and Texas Utilities Company of Messrs. Fish, Driver and Eiland.

While some of the depositions originally scheduled for August had to be postponed, the Department is hopeful that these 1956

depositions can be rescheduled as soon as possible. .

As indicated in the report for July, Ms. Judith L.

Harris has relinquished her lead attorney responsibilities in the present litigation. Ms. Susan Cyphert (202-724-6667) is the new lead attorney for the Department of Justice. In addition, David A. Dopsovic, Esquire, whose notice of appearance is attached hereto, has joined the Departmental's staff and has been assigned to this matter.

Throughout the month of August, the Department con-tinued to analyze discovery materials previously received.
