This preliminary notification constitutes EARLY notice of event of POSSIBLE safety or public interest significance.

The information presented is as initially received without verification or evaluation and is basically all that is known by IE staff on this date.

Subject:

SETTLEMENT OF THE DIESEL GENERATOR BUIh_NG AND PLANT AREA FILL This PN is being issued to update information related to settlement of the diesel generator building and plant area fill.

Representatives from NRC and Consumers Power Company met on March 5,1979, in the second of two meetings dealing with the Midland diesel generator building settlement and the adequacy of the foundations under other Class I structures. This meeting, as well as the initial February 23, 1979 meeting, represented a continuation of the NRC's investigation into the cause and extent of the use of questionable soil at the Midland site.

The investigation effort has resulted in the following conclusions:

1.

The quality assurance program for obtaining proper soil compaction of the Midland site was deficient in a number of areas.

2.

Soil of the type used in the foundation of the diesel generator building is also located, to varying degrees, undar other Class I structures. Whereas excessive settlement has bean observed with the diesel generator building, the settlement of other Class I structures has not exceeded predicted values.

3.

Several incorrect statements are contained in the FSAR with respect to the soil foundation.

The licensee is still evaluating this matter and has concluded that while inadequate compaction has contributed to the settlement, the total cause for the condition is still undetermined and under investigation.

The safety aspects of this matter are being pursued by both IE and NRR.

This matter has been presented to the sittina ASLB as a contention in connection with the Midland plant operating license hearing.

Local interest in this problem has continued.
