PRELIMINARY fl0TIFICATION May 9, 1979 PRELIMINARY fl0TIFICATION OF EVENT OR UflVSUAL OCCURRENCE--PNO-79-105 This preliminary notification constitutes EARLY notice of an event of POSSIBLE safety or public interest significance.
The information presented is as initially received without verification or evaluation and is basically all that is known by IE staff on this date.

SUBJECT:
EXCAVATION AT FORMER RADI0IS0 TOPE BURIAL SITE Several years ago the Veterans Administration (VA) Hospital, an f1RC licensee, sold an adjacent parcel of land, part of which had been used for a low level radioisotope burial site from 1953 to 1965.
VA Hospital records apparently reveal that only millicurie amounts of shortlived isotopes were buried under the provisions of 10 CFR 20.304.
The present land owner was apparently satisfied several years ago that the burials were permissible, but now his construction lerder is reluctant to proceed without certification from State or Federal officials that the land is suitable for an apartment complex.
The land area involved is about 120' X 75' X 4' deep.
Kentucky Agreement State officials are reviewing the i trial records now and a decision will be made in concert with NRC as to whether the records are sufficiently credible to preclude the possibility that long lived isotopes may also be present.
It is possible that the parties involved may have to arrange for surveys of this area during the excavation process, if there is any doubt concerning the com-pleteness of the records.
Region II will monitor any such activities in cooper-ation with Kentucky officials.
A news release is not planned at this time by the Commonwealth of Kentucky or the NRC.
Region II (Atlanta) received notification of this occurrence by telephone at 11:15 on 5/8/79 from the Office of State Programs.
