REPORT OF TUGCO, et al., - DECEMBER, 1973 Pursuant to the direction of the Atomic Safety and Licensing Board during the Special Prehearing Conference on June 21, 1978 (Tr. 124-125) in South Texas, and during the conferences in Comanche Peak and South Texas on December 5, 1978' (Tr. 79-90),

TUGCO sub' nits this report on discovery during the month of December, 1978.

TUGCO has requested an extension of time to January 12, 1979 within which to respond or object to the interrogatories and document requests of the Department of Justice.

The Department did not object to the granting of the requested extension of time.

TUGCO has received the responses of the NRC Staff to Houston Lighting & Power's interrogatories as well as copies of the docu-ments produced to counsel for HL&P by the Staff.

Identifyinginformationregardingdocumentsastowhi[h privilege is asserted and copies of other documents as to which, on reflection, privilege is not asserted were sent to the Depart-ment on December 27, 1973.

Also during December, arrangements were made for a represen-tative of the City of Brownsville to inspect documents in Dallas and Fort Worth.

A similar offer was made to Tex-La which de-clined the opportunity to review discovery materials and related files from the District Court litigation (i. e., those files which were reviewed by NRC and the Department of Justice in September, 1973), being content to review copies of the documents selected for copying by the Department and NRC.

Otherwise, TUGCO did not initiate or receive, nor was it consulted regarding, any discovery requests during the month of December.
