Dear Mr. Roisman:
I This supplements our previous letter to you which responded to your letter dated October 25, 1978, in which you requested, pursuant to the
~
Freedom of Information Act, documents relating generally to the amendments to 10 CFR Part 21, effective October 19, 1978.
Your request was received by the Office of Administration on October 27, 1978.
In further response to your request, the additional documents listed in Appendix A are being placed in the NRC Public Document Room (PDR).
The attachments to document 1 of Appendix B contain information which the vendor considers confidential business (proprietary) information and are being withheld from public disclosure pursuant to exemption (4) of the Freedom of Information Act (5 U.S.C. 552(b)(4)) and 10 CFR 9.5(a)(4) of the Commission's regulations.
We have asked the originators of this information to rejustify their proprietary claim, and will let you know as soon as possible whether the attachments, or any portions thereof, may be disclosed to the public.
A copy of the letter transmitting the attachments to document 1 of Appendix B is also being placed in the PDR.
Documents 2, 3, and 4 of Appendix B are drafts or other documents containing advice, opinions, and recommendations of the staff, and documents 5 and 6 of Appendix E contain information covered by the lawyer-client privilege and are being withheld from public disclosure pursuant to Exemption (5) of the Freedom of Information Act (5 U.S.C.
552(b)(5)) and 10 CFR 9.5(a)(5) of the Commission's regulations.
Pursuant to 10 CFR 9.9 and 9.15 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure, and that its production or disclosure is contrary to the public interest.
The persons responsible for the denial of the attachments to document 1 of Appendix B are the undersigned and Mr. John G. Davis, Acting Director, Office of Inspection and Enforcemeat.
The person responsible for the denial of documents 2, 3, and 4 of Appendix B is Mr.
Samuel J. Chilk, Secretary of the Commission.
The person responsible for the denial of documents 5 and 6 of Appendix B is Mr. James L.
Kelley, Acting General Counsel.

The denials by Mr. Davis and myself may be appea' led to the Executive Director for Operatians within 30 days from the receipt of this letter.
Any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commission, Washington, DC 20555, and should clearly state on the envelope and in the letter that it is an " Appeal from an Initial F0IA Decision." The denials by Mr.
Chilk and by Mr. Kelley may be appealed within 30 days to the Commission and should be addressed to the Secretary of the Commission.
