By your application dated March 22,1978 (AW-78-27) and the accompaning affidavic dated July 27,1976 (AW-76-31) you requested that licensing topical report WCAP-9272 " Westinghouse Reload Safety Evaluation Methodology" be withheld from public disclosure pursuant to 10 CFR 2.790.

Subsequent to discussions with the staff you modified some of the information to be withheld as detailed in your letter dated September 21, 1978.

Your reasons for requesting our withholding of this information were that it reveals the distinguishing aspects of your reload methodology; the information was developed at considerable expense to your Company; and it is the type of information customarily held in confidence by you and not customarily disclosed to the public; therefore, its disclosure is likely to cause substantial harm to your competitive position in selling nuclear fuel and related services.

We have reviewed your application and revised Material based on the requirements and criteria of 10 CFR 2.790 and have determined that the above mentioned document sought to be withheld contains trade secrets or confidential or privileged commercial or financial information.

We also have found that the right of the pub ic to be fully apprised of the proprietary details of your reload metho. logy does not outweigh the demonstrated concern for protection of your ampetitive position.

Considerable details on the reload methodol are available in the non-s proprietary version of the report WCAP-9273 es amended by letter dated September 21, 1 978 which has been placed in the Commission's Public Document Room located at 1717 H Street, N. W., Washington, D.C., for inspec-tion by interested members of the public. Accordingly, we have determined that the information should be witi. held from public disclosure.

We therefore approve your request for withholding pursuant to Section 2.790 of 10 CFR Part 2 and are withholding WCAP-9272 as amended from public inspection as proprietary.

If the need arises, we may send copies of this information to our consultants working in this area. We will, of course, assure that the consultants have signed the appropriate agreements for handling proprie-ta ry da ta.

If the basis for withholding this information from public inspection should change in the future such that the information could then be made available for public inspection, you should promptly notify the NRC.
