REPORT OF THE DEPARTMENT OF JUST t_ - SEPTEMBER, 1979 Pursuant to the Order dated June 21, 1978, issued by the Atomic Safety and Licensing Board (" Board"), the Department of Justice (" Department") submits this report on the progress made in completing discovery during the month of September, 1979.

During the month of September, the Dcpartment was involved primarily with the taking of depositions. The Depart-nent deposed Messrs. Wilson, Spruce, Mecke, Payett, Arnold, Dreiss and Poston. In conjunction with the NRC staff, the Department deposed Messrs. McReynolds, Evans, Sykora, Meyer, Simmons and Williams. The Department also participated in the depositions jointly noticed by Houston Lighting & Power Company ("HL&P") and Texas Utilities Generating Company of Messrs. Robson, Gross, Buchanan and Nichols.-

Pursuant to an extension of time for filing granted by the Board on September 20, the Department on September 26 submitted its " Answer to the Motion of Houston Lighting &

Power Company to Compel Production by the Department of Justice of Certain Drafts of Testimony Prepared by William E. Scott" filed by HL&P September 10, 1979.

While some of the depositions originally scheduled for September were postponed, the Department is hopeful that these depositions can be rescheduled as soon as possible and is working with the other parties in this regard.

Throughout the month of September, the Department continued tc analyze discovery material previously received.
