ORDER CONCERNING CESG'S PETITION TO 00tfEL DISCOVERY (OctoLC2 31, 1979)

On October 2,1979, the Intervenor Carolina Environmental Study Group (CESG) filed a petition to corroel the Appliemt to respond to its discovery requests regarding a cask drop accident. The Applicant filed its opposition to this petition on October 17.

The cask drop contention was raised the first tire en Septaber 4,1979, in written testircny prefiled by CESG. At the evidentiary hearing on September 11, 1979, the Board permitted this contention even though it was untimely because a potential health and safety question could be involved.

It was further held that CESG was familiar with the subject matter and that it should proceed with its testimony without undaly prolonging the hearing (Tr. 4352-54,4358-59,4498).

Iten A in the petition refers to a rail cask. The application in question here involves a truck cask, not a rail cask. We adhere to our prior ruling that rail casks are beycnd the scope of this hearing (Tr. 4374), and deny Iten A.

. With respect to Item B, it appears that Applicant has provided the dimension drawing requested, which shows the location of the weir gate slots. The notion for further discovery is denied.

With respect to Itaa C, that part referring to a railroad cask is again denied (Tr. 4374). However, regarding the question about consequences of a cask drop into the fuel storage pool, the Board notes that replies to its questions about criticality and radioactive anissiens to the public were in the nature of stumary statew its (Tr. 4439-47). The Board therefore requests that the part.ies supple ent these answers with ntrerical analyses, and include the additional question of radioactive exposure of operating enployees.
