The amendment to Part 140, which was effective on May 1, 1977, modifies the definition of "in the course of transportation" in Article I to include transportation outside the United States and supersedes the definition which included only trans-portation within the United Stater,.

E-46 AMENDMENT N0. 10 Effective May 1,1977, Indemnity Agreement No. E-46, between Mississippi State University, and the Atomic Energy Commission, dated March 2, 1966, as amended, is hereby further amended by modifying the prefatory lenguage of paragraph 4, Article I, to read as follows:

"In the course of transportation" means in the tourse of transportation within the United States, or in the course of transportation outside the United States and any other nation, including handling or temporary storage incidental thereto, of the radioactive material to the location or from the location provided that:
