Comission review of proposed issuance of subject license to Transnuclear Incorporated.

In March 1979, Transnuclear filed an application for a li-cence to export 15.038 kilograms of uranium enriched to 45.4% U-E35 and 30.075 kilograms of uranium enriched to 20.3%

U-235 to the FRG. The material, in the fonn of UF, will be 6

shipped to NUKEM (F. A. completed) in the FRG for conversion and fabrication of prot 6 type high-density, lower enrichment MTR-type fuel elements and plates. The fuel elements, each containing from 150 to 500 grams of U-235, are intended for testing in the following research reactors:

ASTRA in Austria (F. A. completed), IEAR-1 in Brazil (F. A. completed), DR-3 in Denmark (F. A. completed), GRR-1 in Greece (F. A. completed),

HFR Petten in the Netherlands (F. A. under negotiation), R-2 Studsvik in Sweden (F. A. completed), SAPHIR in Switzerland (F. A. completed), RV-1 in Venezuela (F. A. completed), and the FRJ-1 (F. A. under negotiation), FRG-2 (F. A. under negotiation), and FRMB (F. A. completed) in the FRG.

In response to our March 26, 1979 request for views on the proposed export to EURATOM, which in this case is only an intermediate consignee, the Executive Branch has (1) concluded that issuance of the proposed license would not be inimical to the interests of the United States, including the common

defense and security; (2) confirmed that the material will be (Co* +.i nued) subject to all the tenns and conditions of the US-EURATOM Additional Agreement for Cooperation; (3) noted that the mem-bers of EURATOM have adhered to the provisions of the Addi-tional Agreement for Cooperation with the United States; and (4) advised that there were no material changed circumstances since submission of its detailed analysis of December 8,1978 on proposed exports of high enriched uranium to EURATOM (see XSNM-1241, SECY-78-645A; XSNM-1238, SECY 78-641 A; XSNM-1232, SECY-78-640A; and XSNM-1212, SECY 78-639A).

The staff believes that there are no material changed circum-stances concerning exports to EURATOM which would affect the Comission's consideration of licensing c teria and which have occurred since issuance of export licenses (e.g., XSNM-1104, SECY-78-516 and XSNM-1241, SECY-78-645A) for similar material to EURATOM after Comission review. Accordingly, the staff believes tha*. this proposed license to the FRG for conversion and fabrication purposes and re-export within the EURATOM Community may be issued. This procedure is authorized by 8110.44(a)(2) of the AEA as amended by the Nuclear Non-Proliferation Act of 1978.

The staff wishes to note that the re-export of the fabricated fuel elements to countries outside the European Comunity would be subject to Department of Energy authorization as subsequent arrangements. All retransfers would be subject to appropriate agreements for cooperation and, of course, the Nr.C will be consulted before authorization is approved.

The Comission will note that the material requested in the application is medium enriched uranium intended for research experiments being conducted at various reactors in a joint test to demonstrate the feasibility of converting to use of medium-enriched and low-enriched fuels.

Besides this, NUKEM itself will use a portion of the materials for its own R & D program such as fabricating high density fuel plates to be tested in different reactors including the Oak Ridge Research Reactor.

This unique project is being performed in conformance with US policy direction to reduce U-235 enrichments and minimize HEU inventory.

It should be noted that the quantity of material in each fuel element is relatively small and would be of little consequence from a proliferation standpoint.

3 Discussion:

Recently, the Delegation of the Commission of the European (Continued)

Communities has requested expeditious Commission consideration of the proposed license. EURATOM is demonstrating its efforts at attempting to undertake test irradiation of prototype fuel of reduced U-235 enrichment. Delays in obtaining fuel may cause interruption of these important research experiments.

The following documents are forwarded for Commission review of the subject applicatio u (1) application of March 21, 1979 (Appendix A); (2) Executive Branch views of July 19, 1979 (Appendix B); and (3) copy of proposed license (Appendix C).

This action involves no new re ource requirements.

NMSS Technical The exported material will be processed solely at NUKEM Review:

where a facility attachment is in force.

A classified NMSS Technical Assessment of IAEA Safeguards Implementation at the NUKEM Facility is being forwarded separately.

Although insufficient information is available to completely evaluate the adequacy of safeguards in the FRG, NMSS believes that while there may be some weaknesses in safeguards inplemen-tation, the proposed export would not cause serious or addi-tional safeguards problems in the recipient country.

NMSS has reviewed the physical security program in the FRG and found it adequate for the purpose of this export.

NMSS has not completed safeguards and Category I physical security analyses for several of the countries to which the finished fuel elements will subsequently be re-transferred.

The transfers to countries outside the European Community (EC) will be subject to subsequent authorization by DOE, and NRC will be consulted prior to approval.

Transfers within the EC will be covered by the US/ EURATOM Agreement.

0 ELD has no legal objection. NMSS views on the adequacy of the accounting and control system, the effectiveness of IAEA safeguards implementation, and the adequacy of the physical security program in the FRG are as stated above.

This letter is in response to the Commission's let-ters dated March 26 and June"28, 19~9, requerting Execu-tive Branch views as to whether issuance of an export license in accordance with the application hereinafter described would be inimical to the common defense and security of the United States and whether the proposed export meets the applicable criteria of the Atomic Energy Ac t o f 19 5 4, as amended by the Nuclear Non-Proliferation Act of 1978:

NRC No. XSNM01483 -- Application by Trans-nuclear Inc. for authorization to export to the Federal Republic of Germany 6.827 kilo-grams of U-235 contained in 15.038 kilograms of uranium enriched to a maximum of 45.4 per-cent, and 6.105 kilograms of U-235 contained in 30.075 kilograms of uranium enriched to a maximum of 20.3 percent.

This enriched uranium in the form af UF6 will be shipped to NUKEM GmbH, Hanau, FRG for conversion and f abrication of prototype high-densit y, lower enrichment MTR-type fuel elements and plates.

The fuel elements, each containing from 150 to 500 grams of U-235, are intended for test-ing in the following research reactors:

signee would take place pursuant to the Additional Agree-ment for Cooperation Between the United States and the European Atomic Energy Community (EURATOM) as confirmed in a letter from the Delegation of the Commission of the European Communities, EURATOM has adhered to the pro-visions of its Agreement for Cooperation with the United States.

Re-export of the f abricated fuel elements to countries outride of the European Community would be subject to De-partment of Energy authorization as subsequent arrange-ments.

The Executive Branch has reviewed this application arl concluded that the requirements of the Atomic Energy Act, as amended, have been met and that the proposed ex-port to the FRG, a member of the European Atomic Energy Community (EURATOM), for conversion and fabrication of fuel elements and plates will not be inimical to una com-mon defense and security of the United States.

A detailed analysis for EURATOM was submitted December 8, 1978 for NRC license applicasion Nos. XSNM 1241, 1238, 1232 and 1212.

There has been no material change in circumstances since that submission.

On the basis of the foregoing, the Executive Branch recommends that the license for export to the Federal Republic of Germany, and re-export within the European Community, be issued.

Conditions License Number Condition 1 - Licensee shcIl file with the Customs Officer or the Postmester two copies,in addi-tion to those otherwise required, of the Shipper's Export Declcration covering ecch export and mark one of such copies for transmittel to the U.S. Nuclecr Regu-lotory Commission, Washington, D.C. 20555.
