  • Iac6 W NRC STAFF'S MOTION FOR ORDER COMPELLING CITIZENS FOR EMPLOYMENT AN ET.ERGY TO RESPOND TO STAFF INTERROGATORIES ON CONTENTION 14 On May 24, 1979, the NRC (Staff) filed a series of interrogatories directed to the Citizens for Employment and Energy (CEE) in th captioned proceeding. On eptember 24, 1379 CEE filed a dccs..ent entitieo " Citizens for Employment and Energy (CEE) Responses to NRC Staff's Interrogatories" (" Response").1I In its Response, CEE states that it lacks the technical expertise, staff and financing to answer the Staff's interrogatories on Contention 14, and is not in a position to advocate Contention 14 but otherwise interposed no objection to the interrogatories. This a.Tounts to a clear, unjustified refusal to answer tne Staff's interrogatories on that contention.

Accordingly, the NRC Staff respectfully requests, pursuant to 10 CFR 5 2.740(f), that the Board issue an order compelling CEE to answer NRC Staff's interrogatories on Contention 14 submitted to CEE on May 24, 1979.

The Board's order of March 21, 1979 which established discovery schedule in the captioned proceeding, provided for CEE responses to the NRC Staff's interrogatories to be filed by June 29, 1979. Tne NRC Staff did not file

a motion to compel at that time since CEE's representative, Mr. Siegfried, indicated to the undersigned during a telephone conference on July 26, 1979 that the previous CEE representative, Mr. Hiller, had not forwarded the Staff's interrogatories to him and that upon receipt of the inter-rogatories, CEE would respond to them as soon as possible (see NRC Staff's letter of August 6,1979 frcm Henry J. McGurren to Mr. Siegfried).
