HRC STAFF RESPONSE TO AMEilDMENTS TO CONTENTIONS 4,11, 20, AND 36 AND NE'A CONTENTIONS 43 AND 44 SUBMITTED BY JOHN F. DOHERTY By pleading dated September 14, 1979,.Intervenor Doherty filed four amendments to previously filed contentions and also an additional two contentions.
The Staff supports contentions 20, 43, and 44 and opposes contentions 4, ll, and 36 as amended:
4 Amendment to Contention #4 The Intervenor's amendment adds several speculative resolutions to the contention asserting that Applicant must maintain design flexibility to incorporate the eventual ATAS resolution.
These supposed resolutions add nothing to the con-tention and the Staff cor.tinues to oppose it as failing to raise an issue, since Applicant has no final design and is committed to the ATAS resolution.
Amendment to Centention #11 This amendment changes the alleged cause of the previously asserted SFP LOCA and meltdown. Now the Intervenor alleges that a reactor core meltdown would cause

z-plant evacuation and lack of maintenance for the SFP or that the reactor vessel head could blow off so that pieces of metal would penetrate the SFP in contain-ment, causing loss of water.
This is a class 9 accident. At present, the Commission policy prohibits litigation of class 9 accidents.

/ Should Commission policy change the Staff would be willing to reexamine the propriety and the basis for this contention.
Amendment to Contention #20 The amendment takes issue with the Dutt and Baker correlation to be used for reanalysis of the Applicant's fuel performance.
Since there is debate in the scientific communjty concerning the temperature factor in-regard to fuel rod burn up, the Staff believes the Intervenor has shown a factual basis to

support this contention.
Anended Contention 36 This amendment asserts as new basis for the contention that bypass leakage through the drywell is an unresolved issue in the ACNGS SER.
Intervenor has failed to note that resolution of the issue was reported on page 6-3 of the ACNGS Supplement 2 to the SER. Therefore, no basis for the contention has been submitted by amendment and the Staff continues to oppose it.
bl e Intervenor has cited Lono Island Lichting Co. (Shoreham Nuclear Power Th Station) ALAB-156, 6 AEC 831 (1973), to show tnat class 9 accidents can be considered.
In that case it was stated class 9 accidents may be litigated where it can be shown that such an accident is more likely to happen in the subject plant than in others. That showing has not been made here.

. itew Contentions 43 and 44 These contentions address use of cleaning compounds in stainless steel components; and the possible link between water hammer and IGSCC in pipes.
The Staff supports both of these contentions as having a factual basis.
