ALLEGATIONS OF IMPROPRIETY CONCERNING THE PROPOSED PHILIPPINES NHCLEAR POWER PLANT (PNPP)

Purcose:

To inform 1e Comnission of the receipt of a letter from the Canter for i:avelopmert Policy alleging improper activities related to the PNDP, to suggest that the issue.s raised be con-sidered by the Comission in the context of forthcoming dis-cussions concerning the intervention petition on the proposed Philippine reactor export (XR-120).

Discussion:

Enclosed at Appendix A is a letter to NRC from the Center for Development Policy (CDP) which alleges tbat EBASCO may have.

acted improperly in t'ie preparation of the Preliminary Safety Analysis Report (PSAR) concerning the Bataan Peninsula site of the PNPP.

Since the allegations raised in this letter could have an impact on the Comission's deliberations abo 41t the intervention petition as well as its viens regarding constjeration of the health and safety aspects of this export, the staff believes it would be appropriate for the Comission to consider the matters raised in this letter in the context of its current deliberations concerning the intervention petition on Philippine exports (for which the CDP is one of the parties).

A Commission meeting to discuss this matter is currently scheduled for October 10.

In this connection, the CDP has also asked whether NRC's mechanisms for investigation of com-parable allegations in the domestic sector could be used for such export-related questions, e.g., could NRC staff investigators from Washington or the Regional Offices interview the individuals involved to find out if they have any relevant information.

The staff will reviw this request after the Comission decides about the hearing and che sppropri:teness of NRC consideration of health and safety issues for the Philippine case.

As a related m:ltter, Mr. Mattisen of CDP has told the staff that (1) a number of the incividuals referred to in his letter

Discussion:

want to have their identities kept confidential because of Continued concerns about legal liability and their professional reputations (e.g., fears of blackballing" by present or potential employers in the nuclear business), and (2) some of these individuals, who are located in various parts of the United States, have indicated their desire to review the large amount of documentation related to siting of the Philippine reactor prior to deciding whether to provide coments on this matter. At CDP request, on September 30 I spoke by phone to one of the individuals alluded to by CDP in the attached letter who both wanted to review this documentation and was concerned about confidentiality.

I out-lined the status of USG consideration of XR-120 and expressed willingness to receive any information the individual wished to provide.

(None was offered at that point.)

I also offered to assist, to the extent possible, in making relevant documentation available, if the CDP is unable to do so. At this point the CDP, which has access to this documentation through its placement in NRC's public document room, is actively seeking to provide this information to this individual and others who wish to review it.

As the Comission will recall, we had earlier indicated to CDP that we were willing to speak with another. individual who, according to CDP, has first-hand information on the site. We have not contacted the individual directly, but understand that CDP has done so.

The State Department comunicated directly with the individual about two weeks ago to indicatq State's willingness to meet with him and listen to his views. As far'as we are aware no further developments have occurred with respect to this individual. We woald welcome Commission views regarding staff interactions with such individuals in the future.
