LICENSEE'S RESPONSE TO NRC STAFF'S MOTION TO POSTPONE HEARING Licensee has received the NRC Staff's motion of September 5,
- 1979, requesting that the current schedule for filing of the Staff's Safety Evaluation Report (SER), parties' discovery of the SER, the filing of pre-filed testimony and the commencement of hearing be suspended.
The Staff's motion suggests that the schedule for those events not be set until the SER is issued.
Since the Staff determined that it could not issue the SER by the scheduled date of September 7, Licensee agrees that postponement of the foregoing schedule is necessary.
We regret that the information that we have provided to the Staff to date has not yet resolved all matters to the Staff's satisfaction.
In every instance, the Licensee has attempted to provide complete answers to the Staff's questions as promptly as possible, taking into account their number and complexity.
No* withstanding the foregoing efforts and the corresponding efforts of the Staff, it is now apparent that misunderstandings arose be-tween us as to the type and depth of information that the Staff de-g 7910250 3 7(o
sired.
Ue want to assure the Board that we will do everything within our ability to avoid any future such misunderstandings and to facilitate the issuance of an SER at the earliest possible

date.
For this purpose, we intend to request a meeting with the Staff to be held in Bethesda within a few days after the Staff provides us with their remaining questions.
At such a meeti:'g, we would plan to discuss with the Staff both our understanding of the questions they raise and the approach we expect to take in responding, including the type of information we would expect to provide.
If the Board has any additional suggestions as to con-structive steps that could be taken by Licensee or the Staff, we would be pleased to cooperate to the fullest extent.
We note that the Staff proposes to send to the Board and parties weekly reports as to the status of the resolution of open items.
For our part, as soon as the remaining Staff questions are received and the foregoing meeting held, we will inform the Board and the parties of the expected schedule for filing responses.
