Duke Power Cc=pany (Transportation of Spent Fuel frc= Oconee to McGuire) - Public Disclosure of Route Information, Docket No. 70-2623 To Counsel for all Parties:
As a result of the oral argument in this case on Monday, Septem-ber 10, 1979 the Cc==ission has three matters en which it would appreciate the further attention of the parties.
First, as we understand the matter thus fAr, the trucks carrying the spent fuel will be large, well-marked, travelling by day, and thus easily identifiable.
It seems relatively simple for anyone wishing to learn the route er routes of the shi;=ents to wait antil such a truck emerges frc= the power plant at Oconee and follow 1: Oc McGuire.
Since the record indicates that there will be roughly 300 shipments in the space of one year, there will be ample opportunity to folicw a shipment.
Given the substantial public interest in spent fuel shipment routes evidenced by this proceeding, is it not likely that sc=e member of the cublic will follow a shipment, and that the route (s) will becc=e "public?
If sc, what is gained by pro.tecting information specifically describ-ing alternative routes during the hearings?
The Cc=rission would appreciate receiving your views on this question.
Secend, while the Cc==ission has not yet decided whether it wishes cc hcid an 'g camera session to examine the specific routes, it is considering doing so.
The Cc=rission wishes new to arrive at a reasonable protective agreement with the parties fer use in case an _g camera session is held.

I will not disclose to anyone, other than the Nuclear Regulatory Com-mission, who has not signed an affidavit to the same effect as this one, any information specifically identifying routes for the shipment of spent fuel involved in this proceeding and not already disclosed in the public record of this proceeding.
I will protect such information in written form, including transcripts of in, camera sessions at which such information is discussed, so that it will not leave the possession of, will at all times be under the control of, and cannot be read by anyone except a person who has executed an affidavit to the same effect as this one.
