Q This' letter will clarify the production of documents by Gulf States Utilities Company pursuant to the consent Protective Order signed by the parties and endorsed by this Board on July 23, 1979.
By letter dated July 24, 1979, we advised the NRC Staff, the Department of Justice, and Mr. Poirier of Spiegel and McDiarmid that the copies of the documents requested by the parties had arrived an our office and were available for production.
A copy of that letter is attached.
The documents were picked up by a Department of Justice atecrney several days later.
Therefore, in his letter of August 3, 1979 to this Board, reporting on the monthly discovery activities by the Public Utilities Board of the City of Brownsville, Texas, Mr. Poirier mis-spoke himself in stating that the NRC and the Department of Justice had not yet received copies of the requested documents.
I have since spoken to Mr. Poirier, who informed me that he did not re-ceive a copy of my attached letter of July 24th.
.I trust that this will set the record straight as to Gulf States' comp 1 ance with its commitment to provide the requested documents.

The ccpies of documents requested bv. v.ou and Mr. Clark of the Department cf Justice during your recent visit to Gulf States Utilities Cc=pany in Beau =cnt are new available in my office, subject to receiving the ackacwledgement in writing required hv Parac.rac.h 7 cf the Stic.ulation to Protective Order.
Included with the materials is a copy of the log which was made by tn.e persen w..o = ace a,.:. c:. the copies.

s the method felicwed by the document examiners, that is, hand-written nu-ter s rather than a censecut.ive numbering stamp, a few nurters seem to have been skipped and sc=e n=3ers have been designated with a suffix, i.e.,

You will notice that many of the documents bear a large stamp " Confidential" en their face.
I understand frc= Gulf States tha: Susan Childs of the Custice Depar =ent indicated to the copiers that they should stamp all of the documents confidential.
Unfortunatelv., Gulf States did not discover this error until a considerable number of copies had already been made.
