Gentlemen:
DU' By latter to Staff Counsel received September 4,1979, Ms. Elinore P. Cumings stated that her undated, previously filed cetition to iritervene was deposited in the United States mail on July 11, 1979.
The clarification was submitted in reply to the Staff response of August 1,1979, wherein it was noted that since Ms. Cumings' petition was received long after the July 18, 1979 date set for filing petitions to intervene, it was not known whether or not the petition was timely filed. Ms. Cumings' statement shows that the petition was timely filed and the Staff considers it as such according to the previous response.
The Staff is providing c copy of Ms. Cumings' letter to the Board ana service list since Ms. Cumings apparently believed only a personal reply was necessary.
