Settember 10, 1979 ORDER In response to a question frcm the Board during the course of this proc ~d hg, the Staff stated, in its reply dated August 24, 1979, that the

" Staff... concludes that the accident at Three Mile Island was a Class 9 accident."

Since receiving the Staff's reply, it has come to the Board's atten-tion that the Staff has previously made other replies to this same question.

For exacple, in a letter to Congressman Robert J. bgermrsino dated June 29,

1979, Mr. Lee V. Gossick, Executive Director for Operations, stated:

"It should be noted that the Three Mile Island accident is not a Class 9 accident."

The Staff's reply to the board's question is the rest recent reply of which the Board is aware, and it appears to be the only formal statement of the Staff's position on this question in litigation. TPa Board will con-tinue to assume that the Staff's reply to the Board is the Staff's true posi-tion, unless the Board is infonned otherwise.
