Dear Mr. and Mrs. Schrantz:
This is in response to your letter of August 16, 1979, with respect to utility rate increases by Met opolitan Edison Company resulting from the incident at Three Mile Island Unit We recognize your concern about the rate increases due to the utility having to purchase electrical poweq because of the outage at Three Mile Island.
Such matters as rate s$cture, hhwever, are not within the purview of the Nuclear Regulatory Commission (NRC) bt.
are solely within the province of the State.
Any decision as to the " pass-th.ough" of these costs would be under the juris-diction of the state public utill regulatory agency.
Some concern by the public has been xpressed as to possible NRC civil penalty action against the licensee.
There h been no decision at this time as to enforcement action that may be taken by the NRC with respect to the incident at Three Mile Island Unit 2.
In connect 1 n with our general enforcement policy, the NRC has surveyed the states to find ou how NRC civil penalties are handled in utility rate cases.
As a re: ult of that urvey, it was learned that the Commonwealth of Pennsylvania has a formal pol y on " pass-through" and does not permit " permit " pass-through" unless the utilit 's solvency is threatened.
