AFTERNOON SESSION 2
(1:58 m.m.)
3 CHAIRMAN HENDRIE:
I would like to announce for 4
the edification of the assembled audience, that since we i
didn' t ge t to a couple of affirmation items and to a 6
discussion -- hopefully, a orief discussion -- on another
/
item this morning, I am going to start with those, so that 3
what on the Commission's schedule, the revised schedule for 9
Thursday, 0:tober 4th, were items two and three in the 10 morning session now become one and two in the af ternoon 11 session.
12 Let's see, there is one affirmation item wnich we 13 can t ake up, whien I believe we are sufficiently well agreeo 14 upon.
So we c an simply do it.
15 MR. H0YLE:
That woulo ce an add-on item.
I would 15 ask you to call for an add-on to that.
17 CHAIRMAN HENDRIE:
I woulo ask my colleagues to 13 join me in voting to hold a short notice meeting to deal 19 with the affirmation of approval under section 145(o) for 20 certe in arrangements connected witn the employment of a 21 consultant to Commissioner 3111nsky.
22 All in f avor?
23 (Chorus of eyes.)
24 CHAIRMAN HENDRIE:
So ordered.
John, will you 25 pleasa lead us in tne reading of tne a f f i rma't ion ?

MR. H0YLE:
This is SECY paper 79-558.
And it 2
recommends approval under section 145(b) of the Atomic 3
Energy Ac t.
The employment of Paul Langer as a consultant 4
to Commissioner Gilinsky, and for access to national 5
secur ity inf ormation.
I have indication of affirmative 5
votes f rom a ll of your o f fices, and Cornissioner Kennedy as I
well.
3 CHAIRMAN HENDRIE:
Will you please affirm your 2
votes by voting eye.
13 (Chorus of ayes.)
11 CHAIRMAN HENDRIE:
So ordered.
12 MR. H0YLE:
I could perhaps begin describing 13 numoer three item on this morning's calerdar.
14 CHAIRMAN HENDRIE:
Why don' t you do that?
15 MR. H0YLE:
It is SECY-79-480.
it is an appeal 15 under tne Fr eedom of Information Act by Mr. Troy Connor of Ie the denial of certain documents withneld f rom him earlier.
15 There are 11 documents involved.
Tne commissioners have li indic ateo votes in the f ollowing manner s the General 23 Counsel had indicated release now of four of the 11 21 documents.
Three of you have agreed to that 22 r e co mme nda t i on.
Two commissioners, Gilinsky and Bredf ord, 23 woulo f avor releasing additional documents.
Cammissioner 24 Gilinsky, all 11 with the exception o f some non-f ac cual 25 information in one of them.
Commissioner Bradford would l1JD 33/~

release 10 o f the 11, deferring to the General Counsel.
2 Commissioner Kennedy is one of those who has indicated a 3
vote favoring release of only four.
And the r e f o r e. I 4
celi +ve he should be in the room as we affirm the votes.
5 CHAIRMAN HENDRIE:
I hope so, or I may lose it.
o Is there a statute of time on the thing?
i MR. H0YLE:
If there were a statute of time --
3 CHAIRMAN HENDRIE:
You are jus t in time to affirm 9
your vote on 79-480.
10 MR. H0YLE:
It is the FOIA appeal of Troy Conner.
11 CHAIRMAN HENDRIE:
I will ask us all to affirm our 12 votes.
13 (Chorus of ayes.)
14 MR. H0YLE:
The letter to Mr. Connor will point 15 out the positions of the Commissioners Gilinsky and 15 Bradford.
Il CHAIRMAN HENDRIE:
Yes.
13 That brings us to the paper 79-479.
19 COMMISSIONER KENNEDY:
Since the matter to release 2J is a matter of a Commission decision, is it appropriate to 21 normally, then, conf er or convey to e ach of the parties the 22 individual views of each commissioner on the matter?
Is 23 that the normal course of events ?
24 MR. SICKdIT:
I dont' know what the Cocaission's 25 practice has oeen, normally.
I think it is a reasonacle i155 358

course to take.
2 COMMISSIONER KENNEDY:
That's all I wanted to 3
know.
Thank you.
4 (Whereupon, at 2:04 p.m.,
the hearing was 5
adjourned.)
