Dear Mr. Dawley:
l Your July 16, 1979 letter to Mr. Harold Denton, Director of the Officq of Nuclear Reactor Regulation, has been referred to me for response.
j In your letter you expressed opposition to construction of the Waterford Unit 3 nuclear power plant because "it is not being constructed the way it is( designed and approved to be constructed" and because "it is not possible to evapuate people from the surrounding area in case of an accident."
I Concerning construction deficiencies, you said you did not have " complete informationonthispoint"andthata"simplecheckontheapprovedplpnsand the actual constructicn will confirm this point."
You did not presentiany details as to how the construction is not in accordance with approved hians.
Our Office of Inspection and Enforcement (0IE) conducts frequent inspections of construction work in progress. Some inspections are announced and pthers are unannounced. During these inspections, trained inspectors observe con-struction activities and examine records of such activities. All these activities must be accomplished in accordance with the Commission's rules and regulations. During any large construction effort, such as that involved in building a nuclear power plant, there may crop up items that require repair or re-work in order to meet construction requirements.
To date there has been no evidence, however, that deficiencies that might substantially affect the safety of the Waterford plant have not been discovered and remedied.

In accordance with the Commission's rules and regulations the licensee (utility) must prepare an emergency plan and submit it for our review.
Such a plan is normally prepared in conjunction with state and local governments 4having the responsibility and authority to control the activities of people outside the plant property. The capability of local and state authorities to arrange for evacuation has been demonstrated in cases of such occurrences as hurricanes, floods, fires, and leakage of dangerous chemicals. Even before the accident at the Three Mile Island nuclear plant, the NRC has been working with the various state and local governments on emergency preparedness. Since the occurrence of that accident, greater effort is being expended to expedite the development of adequate emergency plans by states that presently do not have them.

You might be interested to know that three citizens groups have petitioned to intervene in the Waterford proceeding. These groups are Save Our Wetlands and the Oystershell Alliance, as co-petitioners, and the Louisiana Consumers League.
Included in their contentions is one addressing the matter of'emer-gency plans and evacuation. Another contention addresses construction defi-ciencies and several others are concerned with health effects from plant operation. A public hearing will probably be held in New Orleans at some later date at which time these contentions and others may be litigatedg For your information I have enclosed a copy of the " Notice of Receipt ' f Appli-O cation" that was published in the " States Item" and " Morning Advocate"inews-papers on January 2,1979 and a copy of the " Notice of Hearing." These notices included information on public participation in the Waterford proceedirig. Also enclosed is a paper entitled "The Reactor Licensing Process" that summ'trizes the process by which a nuclear power reactor is licensed.

Reg.125, the Staff of the Nuclear Regulatory Comission published a notice which, inter alia,' stated that the Comission had received an application for a facility operating license from Louisiana Power and Light Company (Applicant) to possess, use and operate the Waterford Steam Electric Station, Unit 3, a pres -
