Dear Mr. Vargas:
On October 31, 1979, we sent the referenced letter to Nuclear Regu-latory Commission Inspection and Enforcement requesting relief from the reporting requirements of Technical Specifications SR NR 1.1 and SR NR 1.3.
Since the report would have been sent to Inspection and Enforcement, we felt it appropriate to address our request for relief from re-porting to that office. Our request was based on the fact that, al-though Fort St. Vrain has been accepted by Public Service Company for commercial operation, the plant has not yet reached 100% power,-
nor has the Technical Specification definition of commercial opera-tion been met.
In addition, evaluation by Water Chemistry personnel indicates that data taken under the present 70% power restriction is not representative of 100% power conditions. Due to the number of variables, the actual impact of 100% power generation cannot be es-timated.
We request that your office waive the reporting requirements of SR NR 1.1 and SR NR 1.3 until 100% power operation is attained, or un-til 70% is determined to be the maximum attainable power level, if that should be the case.
