APPENDIX A NOTICE OF VIOLATION Metropolitan Edison Company Docket No. 50-289 This refers to the investigation conducted by representatives of the NRC Region I (Philadelphia) office of the Three Mile Island Nuclear Station, Unit 1, Middletown, Pennsylvania, of activities authorized by NRC License No.

DPR-50.

During this investigation conducted from April 19, 1979 to June 12, 1979, the following apparent item of noncompliance was identified:

10 CFR 50, Appendix B, Criterion XVI, Corrective Action, states, in part, that:

" Measures shall be established to assure that conditions adverse to quality...are promptly identified and corrected.

In the case of significant conditions adverse to quality, the measures shall assure that the cause of the condition is determined and corrective action taken to preclude repetition."

The Three Mile Island Nuclear Station Unit 1 FSAR, Appendix 1A, Opera-tional Quality tssurance Plan, Section 21, Corrective Action, states, in part, that:

"An evaluation of a nonconformance includes consideration of the cause...and solutions that reduce the probability of repetition of the nonconformance.

... procedures include provisions for the identification of problems and deficiencies,...and for re-audits or inspections to assure that corrective action and documentation are accomplished."

Section XVI of the Operational Quality Assurance Plan, Revision 7, states:

"The audit and surveillance finding followup activities shall be performed in accordance with a written procedure which ensures verification of the timely and proper implementation of cor ective action to preclude repetition of deficiencies."

Contrary to the above, previously identified deficiencies were found to be repetitive in that during the inservice inspection activities performed during February 20 to Maren 10, 1979, nondestructive examination data records contained inaccuracies, omissions, and errors similar in nature to those identified during the previous inservice inspection which was documented on QC Surveillance Report TMI 78-69 dated April 11, 1978.
