MEMORANDUM (Novemter 19, 1979)
During the course of this proceeding the board and the

parties have been served with various staff documents ~
and the report of the President's Commission on the Accident at Three Mile Island.
These papers purport to explain some of the events underlying the accident.
We have carefully examined these documents so that we will be prepared to consider the scope of the proceeding, the bases for con-tentions, and the nature and extent of discovery.

1504 016 bk 7912050 the nature of the Commission's concerns leading to this proceeding and to place the short term actions required by the Commission's Order and Notice of Hearing into context for the benefit of members of the public attending the sessions.

The comments were based upon a reading of the various documents filed by the staff and the report of the President's Commission.
Subsequently during bench conferences on November 16 and 17, counsel for licensee stated that the remarks could be interpreted to indicate that the board member has prejudged some of the issues in this proceeding.
Upon reading the transcript we can see that it may appear that the board member has prejudged the matters referred to.
We wish to assure all parties that such is not the case.
The licensee has not yet had an opportunity to state its position with respect to the matters covered in the board member's ccaments.
Our decision will be based only upon the whole record of the proceeding.
