This is in response to your letter of September 18, 1979 which transmitted revised pages to your Fundamental Nuclear Material Control Plan. The revisions, which allow greater flexibility in scheduling physical inventories, are in accordance with the guidance provided in our July 6,1979 letter.
Accordingly, Safeguards Amendment MPP-1 to your License No. SNM-778 is her.eby revised, effective immediately, by revising existing License Condition 2.1 and adding a new Condition 5.1 to read as follows:
2.1 The licensee shall follow the Fundauental Nuclear Material Control Plan dated July 1977 with the foi10 wing revisions:
a.
new page 2.6 dated April 1978; b.
revised pages 3.8 and 4.2 dated November 1978; c.
revised Chapters 5 and 4 with the exception of Item 4.2.4.3 (bias correction} both dated August and October 1978; d.
revised page 5.1 dated August 1979; and as revised in accordance with the provisions of 10 CFR 70.32(c).
5.1 Notwithstanding the requirements of 10 CFR 70.51(e)(3) to conduct physical inventories at stated intervals, the licensee shall follow Section 5.1.1 of the Plan identified in License Conditica 2.1.
} /} !} 3 23 fj 7911300 We have established that the attachment to your letter dated September 18, 1979 contains information of a type specified in 10 CFR 2.790(d).
Accordingly, pursuant to Section 2.790(d)(1), your letter is deemed to be comercial or financial information within the meaning of 10 CFR 9.5(a)(4) and shall be subject to disclosure only in accordance with the provisions of 10 CFR 9.12.
