Duke Power Company (Amendment to Materials License SNM-1773 -- Transportation of Spent Fuel from Oconee Nuclear Station for Storage at McGuire Nuclear Station), Docket No. 70-2623 TO THE PARTIES:
This is to confirm our previous telephone conversations concerning the affidavit attached to the Commission's Order of November 2.
The affidavit defines an " authorized person" to include "a person who already possesses all of the [ protected] information."
The purpose of this clause is to assure that the affidavit does not bar the counsel for the licensee from discussing the material with licensee personnel who have generated and workee with the protected information and who will comply with the Commission's directions on whether it is to be protected.
Other persons may believe they know part or most of the routes, but we know no one outside the Commission or the licensee who knows all the protected information with certainty.
We interpret the phrase "a person who already possesses all of the [ protected] information" to add only licensee personnel to the definition of an " authorized person."
