DEPARTMENT OF ENVIRONMENTAL RESOURCES STANDARD CONDITIONS RELATING TO EROSION CONTPOL For use in Vater quality Management Permits 1973 General By approval of the plans for which this permit is issued, neither the Depart-1.

ment nor the Commonwealth of Pennsylvania assumes any responsibility for the feasibility of the plans or the operation of the measures and facilities to be constructed thereunder.

All relevant conditions of any prior water quality management permits, decrees, 2.

or orders issued to the herein permittee or his predecessor shall be continued in full force and effect uniess expilcitly superceded by this permit. The pro-visions of this permit shall apply to the permittee's successors, lessees, heirs and assigns.

E The responsibility for the' carrying out of the conditions of this permit shall

3 rest upon the owner, lessee, assignee, or other party in responsible manager-ial charge of the earthmoving affecting the runoff and of the erosion control f acilities herein approved, such responsibility passing with each succession in said control. Approval of measures and facilities under a permit shall not be ef fective as to a new owner until a transfer has been executed and filed on forms provided by the Department and the transfer is approved by the Depart-ment.

The permittee shall secure any necessary permission from the proper federal 4.

authority for any outfall or structure which discharges into or enters navigable waters.

In order to avoid obsolescence of the plans of erosion control measures and 5

f acilities, the approval of the plans herein granted, and the authority

. granted in the permit, if not specifically extended, shall cease and be null and void two years from the date of this permit unless the erosion control measures and facilities covered by said plans shall have been com-pleted and placed in operation on or before that date. Also, cancellation of permits by the Regional Sanitary Engineer or Vater quality Manager may be possible six months after construction has ended.

6.

Approval of plans refers to functional design and not constructional stability, which is assu ed to be sound and in accordance with good structural design.

Failure of the measures and facilities herein approved because of faulty structural design or peor construction will render the permit void.

7.

If at any time the activities undertaken pursuant to this permit or the discharge of the effluen' therefrom is causing or contributing to pullution of the waters of the Commonwealth, the permittee shall forthwith adopt such remedial measures as are acceptable to the Department.

8.

The Clean Streams Law and the Regulations promulgated thereunder are incorporated into and made pa.-t of this permit.

9 The permittee shall have his erosion control plan available at the site of the activity at al1 times.

Construction 10.

At least seven days before earthmoving w* ll begin, the permittee, by certified mail, shall notify the Regional Sanitary Engineer or Water Quality Manager of the date for beginning of construction.

11.

All earthmoving activities shall be undertaken in such a manner as to minimize the areal extent of disturbed land.

12.

All surface wa:er upslope of the project area shall be kept away by diverting the water around the project area.

13 The erosion control measures and facilities shall be constructed under expert professional supervision and competent inspection, and in accordance with plans, designs, and other data as herein approved or emended, and with the conditions of this permit.

14. No radical changes shall be made in the measures and facilities herein approved without approval of the Deaprtment.

Revisions which do not change the control measures and f acilities or the points of discharge may be approved by the Regional Sanitary Engineer or Water Quality Manager upon submission of plans. Other revisions must be approved by a permit.

15 When the herein approved erosion control measures and facilities are completed, the permittee shall notify the Department so that an inspection of the measures and facilities may be made by a representa-tive of the Department.

l 3-17 The erosion control measures and facilities herein approved shall be maintained in proper condition so that they will individually and collectively perform the functions for which they were designed.

In order to insure the ef ficacy and proper maintenance of the measures and facilities, the permittee shall make periodic inspections at sufficiently frequent intervals to detect any impairment of the structural stability, adequate capacity, or other requisites of the herein approved measures and facilities which might impair their effectiveness, and shall take immediate steps to correct any such impairment found to exist.

18.

Sediment shall at no time be permitted to accumulate in sedimenta--

tion basins to a depth sufficient to limi t storage capaci ty or inter-fere with the settling ef ficiency thereof. Any such material removed shall be handled and disposed of so that a problem is not created and so that every reasonable and practical precaution is taken to prevent the said traterial from reaching the waters of the Common-wealth.

19 All slopes, channels, ditches or any disturbed area shall be stabilized as soon as possible after the final grade or final earthmoving has been completed. 20.

Upon completion of the project, all areas which were disturbed by the project shall be stabilized so that accelerated erosion will be prevented. Any erosion and sedimentation control facility required or necessary to protect areas from erosion during the stabilization period shall be maintained until stabilization is completed.

Upon corrpletion of stabilization, all unnecessary or unusable control measures and facilities shall be removed, the areas shall be graded and the soils shall be stabilized.

Sewers herein approved shall have tight, well-fitting joints, shall be laid with straight THREE:

alignment and grade and shall have smooth interior surfaces. The sewers shall have adequate foundation support as soil conditions require. Special care shall be taken in construction of sewers under deep or shallow cover and under other conditions which impose extra hazards to sewer stability.

Trenches shall be back-filled such that the sewers will have proper structural stability, with minimum setting and adequate protection against breakage. Concrete used in connection with these sewers shall be protected until cured from injury by water, freezing, drying or other harmful conditions.

in grade or alignment, at summit ends, and upon straight lines at intervals not exceeding four hundred feet, or wherever necessary to permit satisfactory entrance to and maintenance of the sewers; manhole inverts shall be so formed as to facilitate the flow of the sewage and to prevent the stranding of sewerage solids, and the whole manhole structure shall have proper structural strength and be so constnacted as to prevent undue infiltration, entrance of street wash or grit, and to provide convenient and safe means of access and maintenance.

discharge of the effluent therefrom, shall'have created a public nuisance, or such disch or contributing to pollution of the waters of the Commonwealth, the permittee shall forthwith adopt such remedial measures as are acceptable to the Department.

Nothing herein contained shall be construed to be an intent on the part of the THIRTEEN:

Department to approve any act made or to ba made by the permittee inconsisten i

lawful powers or with existing laws of the Commonwealth regulating stream pollution and

The approval herein given is specifically made contingent upon the permittee acquiring FOURTEEN:

The various structures and apparatus of the sewage treatment works herein approved SIXTEEN:

The screenings and sludge shall be so handled that nuisance is not crea'.ed and SEVENTEEN:

shall be disposed of in a sanitary manner satisfactory to the Depar ment.

The permhee shall keep records of operation and efficiency of the waste treatment EIGHTEEN:

works and shall submit to the Department, cremptly at the end of each month, such report thereo k

as may be required by the Depa-tment.

NINETEEN:

The sewage "eatment works shall be operated by a competent person or persons.

In this connection attention is directed to the necessity for expert advice and supervision over the

(

operation of the sewage treatment works in order to secure efficiency of operation and protection to the waters of the Commonwealth. To this end the permittee shall place the operation of the sewage treatment works under the control of the designer of the works or some other person expert in the oparation of sewage treatment works, for at least one year after completion thereof and report submitted. The sewage treatment works shall be operated by a operator certified in accordance with the Sewage Treatment Plant and Water Works Operators Certification Act, Act No. 322 approved November 18, 1968 as amended.

TWENTY:

The right to discharge the effluent from the herein approved sewage treatment works

  • into the waters of the Commonwealth is contingent upon such operaticn of these works as will at all times produce an effluent of a quality satisfactory to the De.7artment. If, in the opinion of the Department, thea works are not so operat'ed or if by reason of change in the character of wastes or irweased load upon the works, or changed use or condition of the receiving body of water, c: otherwise, the said effluent ceases to be satisfactory for such discharge, then upon notice by the Department the right herein granted to discharge such effluent shall cease and become null and void unless within the time specified by the Department, the permittee shall adopt such remedial measures as will produce an effluent which, in the opinion of the Department, will be satisfactory for discharge into the said receiving body of water.

TWENTY-ONE:

The attention of the permittee is called to the highly explosive nature of certain gases generated by the digestion of sewage solids when these gases are mixed in proper proportions with air, and to the highly toxic character of certain gases arising f:om such digestion or from

sewage in insufficiently ventilated compartments or sewers. Therefore, at all places throughout the sewerage facilities where hazard of fire, explosion, or danger frcm toxic gases may occur, the permittee shall post conspicuously proper warnings of a permanent and easily legible character and shall provide for the thorough instruction of all employes concerning the aforesaid hazards and in first aid and emergency methods of meeting such hazards and shall further provide, in a conveniently accessible place, all necessary equipment and material therefor.

TWENTY-TWO: Cross connections between a potable water supply and a sewerage system constitute a potential danger to the public health. Thcrefore, all direct and indirect connections whereby under normal or abnormal conditions the potable water supply may become contaminated from an inferior water supply, from any unit of the sewage treat.. tent works, or by any appurtenance thereof or from any part of a sewerage system, are hereby specifically prohibited. The permittee is further warned against permitting to be made permaneat any temporary connection with a potable supply designed to be hGd in place while being used for flushing or other purposes, and is also cautioned against the danger of back siphonage through portable hose lines and similar avenues of possible contamination.

TWENTY-TH REE:

Effective disinfection to control disease producing organisms sha'l be the production of an effluent which will contain a concentration not greater than 200/100 ml of Fecal Coliform organisms as a geometric average value nor greater than 1,000/100 ml of these organisms in more than 10% of the samples tested.

I TW E.NTY-FOU R:

The approval herein granted for sewers is limited to the right to construct the sewers, but approval of connection there t is specifically withheld until such time approval for use thereof is granted by the De,nartment.

TWENTY.FIVE:

The attention of the permittee is directed to the fact that the effluent from the herein approved sewage treatment works is discharged to a dry stream normally without the

benefit of dilution. If the effluent creates a health hazard or nuisance, the permittee shaft upon notice ; rom the Department of Environmental Resources, provide such additional treatment as may be required by the Department.

TWENTY SIX:

This permit authorized the construction and operation of the proposed sewerage facilities durirg the interim period from the effective date hereof until facilities for conveyance and treatment at a more suitable location, in accordance with either an Official Plan (as defined in the Act of January 24,1966, P. L.1535, The Pennsylvania Sewage Facilities Act) or the Department's Rules and Regulations. Title 25, Part 1, Subpart C, Article 11, Section 91.31, are installed and are capable of receiving and treating the permittee's sewage. When such municipal sewerage facilities become available the permittee shall provide for the conveyance of its sewage to these sewerage facilities, abandon the use of 'the herein-approved facilities, and notify the Department accordingly. This permit shall then, upon notice from the Department, terminate and become null and void, and shall be relinquished to the Department.

TWENTY-SEVEN:

Tae plant hereby approved is required to effect secondary treatment of the sewage which it receives. Secondary treatment is that treatment that will reduce the organic waste load as measured by the biochemical oxygen demand test by at least 85% during the period May 1 to October 31 and by at least 75% during the remainder of the year based on a five consecutive day average of values; will remove practically all of the suspended solids; will provide effective disinfection to control disease producing organisms; will provide satisfactory disposal of sludge; and will reduce the quantities of oil, greases, acids, alkalis, toxic, taste and odor producing substances, I

color, and other substances inimical to the public interest to levels that will not pollute the receiving i

stream.

WENTY-EIGHT:

Records of the opct5 ef the single residence sewage treatment works as the State Department of Environmental Resources may deem necessary for the proper control of the operation of the treatment works shall be kept on forms satisfactory to the Department and shall be filed in the Regional Office of the Department at intervals as specified.

TWENTY-NINE:

The permittee shall submit to the Department by March 31 of each year a report showing the hydraulic and organic load compared to the design load and the expected load for a period of five years hence.

THIRTY:

The permittee shall prohibit additional connections to a sewer system or load from being placed upon a sewage treatment p1 art when the plant capacity will be exceeded within five years unless steps have been taken to enlarge the plant within that time.

THIRTY-ONE:

The permittee shall take the necessary measures for the construction of sewerage facilities in a manner compatible with good con:ervat on methods to minimize the effect on the i

environment, the regimen of the stream bed or channel, and to prevent sediment and pollutants from entering the waters of the Commonwealth.

The local waterways patrolmen of the Pennsylvania Fish Commission shall be notified when the construction of the stream crossing and outfall is started and completed. A k

pr.rmit must be secured from the Pennsylvania Fish Commission if the use of explosives is required.

The permittee shall notify the local waterways patrolmen when explosives are to be used.

THIRTY-TH REE: If future operations by the Commonwealth of Pennsylvania require modification of the stream crossing and/or outfall or there shall be unreasonable obstruction to the free passage of floods or navigation, the permittee shall remne or alter the structural work or obstruction without expense to the Commonwealth of Pennsylv.nia. Nuclear Station (TMI).

As can be seen in reviewing the enclosed plans, reference is made to all TMI HPDES permit identified discharges except discharges 002, 003, and 004. Further, reference was not mada to these three discharges in that, in accordance with the current TMI NPDES permit, compliance was achieved for these three dischar6es on the effective date of the permit.

Should you find that these plans appear to be deficient in any respect, we vould ask that you give us an opportunity to meet with you to discuss the matter before you issue any kind of vritten review statenent. We feel that in this vay ve can quickly clear up any misunderstandings you might have and thereby save sc=e ti=e for both of us.

In this sane regard, it should be noted that if these plans are not approved by February 16, 1976, it is dcubtful whether we vill be able to meet the first milestone of our implementation schedule (i.e. start construction March 1, 19T6; reference the current TMI NPDES permit, part B.1.a, and Section T of the enclosed plans).

We have evaluated the i= pact of defining the effluent limitations as net rather th:m gross, and have found that in this case there would be no significant i= pact on water quality. We therefore agree with your request, and hereby revise the above per=its for Three Mile Isb nd to reflect net limitations. Obviously, this does not apply to the limi-tations on pH and Temperature.

We hope that this will be sufficient to eliminate any problems with permit compliance due to intake water quality.

A. MAN AGEMENT REQUIREMENTS

1. Change in Dischcrge All discharges authorized herein shall be consistent with the terms and conditions of this permit. The discharge of any pollutant identified in this permit more frequently than or l

at a level in excess of that authorized saall constitute a violation of the permit. Any anticipated facility expansions, production increases, or process modifications which will result in new, different, or increased discharges of pollutants must be reported by submission of a new NPDES application or,if such changes will not violate the effluent limitations specified in this permit, by notice to the permit issuing authority of such changes. Following such notice, the permit may be modified to specify and limit any li pollutants not previous!'/ mited

2. Noncompliance Notification If, for any reason, the permittee does not comply with or will be unable to comply with any daily maximum effluent limitation specified in this permit, the permittee shall provide the Regional Administrator and the State with the following information, in writing, within five (5) days of becoming aware of such condition:

A description of the discharge and cause of noncompliance; and i

b. The period of noncompliance, including exact dates and times; or, if not corrected, I

the anticipated time the noncompliance is expected to continue, and steps being taken to reduce, eliminate and prevent recurrence of the noncomplying discharge.

3. Facilities Operation The permittee shall at all times maintain in good working order an'd operate as efficiently as possible all treatment or control facilities or systems installed or used by the permittee l

to achieve comp!!ance with the terms and conditions of this permit.

4. Adverseimpact i

The permittee shall take all reasonable steps to minimize any adverse impact to navigable waters resulting from noncompliance with any effluent limitations specified in this permit, including such accelerated or additional monitoring as necessary to d2termin9 the nature and impact of the noncomplying discharge.

5. Byp.using Any diversion from or bypass of facilities necessary to maintain compliance with the terms and conditiens of this permit is prohibited, except (i) where unavoidable to prevant loss of life or severe property darnage, or (ii) where excessive storm drainage or runoff would damage any facilities necessary for compliance with the effluent limitations and prohibitions of this permit. The permittee shall promptly notify the Regional Administrator and the State in writing of each such diversion or bypass.

6. Civiland CriminalLiability Except as provided in permit conditions on " Bypassing" (Part II, A-5) and " Power Failures" (Part II, A-7), nothing in this permit shall be construed to relieve the permittee from civil or criminal penalties for noncompliance.

Permittee shall submi. to the Regional Administrator no later than 12 months after permit effective date, plans for the com-bination and effective treatment of those categories of Waste streams described in the Final Guidelines for Steam Elcetric Generating Plants (October 8, 1974 Federal Register). Such plans shall include an illustration reporting the flows (mgd) of each waste stream category prior to combination, a description of the proposed treatment for each waste stream category, and an icplementa-tion schedule which shows compliance by July 1, 1977. Upon receipt of such treatment plans by the permit issuing authority the discharge limitations and monitoring requirements will be revised by such auth-ority to include all changes manifested by such treatment plans.

Effective no later than July 1,1977, there shall be no discharge of solids from clarification water treatment.

Please note that public notice of this application has cc==enced and proof of publication vill be for-varded on or about January 17, 1977 Throughout the Engineer's Report and the Application, internal streams and monitoring points are nu=bered as specified by US Environ = ental Protection Agency (EPA). We are required by EPA to have certain additional treatment features associated with TMI in operation to improve the treatment of vastes by July 1, 1977 To meet that deadline, construction on. Unit 2 treatment facilities (foundations and buildings) must co==ence in early January,1977.

We have discussed this Per=it application with Mr. James V. Donato of your office. In his letter dated Dec. 13, 1976 he stated that the DER vould consider granting approval to begin construction, which vould not involve the treatment facilities directly (ie., treatment building and associated outside piping), in early January. We therefore request that you autiorize us to c a nce construction i==ediately on these facilities, at our risk, while the Department is processing the application.

From this cump all the wastes are pumped te a treatment system where the wastes are conditioned and the solids removed by pressure filtration to a level allowable by the permit. The final e f fluent is f low monitored and 4.uup l ed p r io r te combination with any other plant stream.

Sludre Collection Sump The existing sludge collection sump will be utilized as a common collection point for all the wastes requiring solids removal. Agitation will be provided to assure constant mixing as well as to keep all solids in suspension. The sump provides equalization of all intermittant incoming flows.

Sludge Feed Pumps Two pumps each of equal size will be installed in the sump to pump the wastes on a batch basis to a reaction mix tenk.

t Chemical Conditioning Phase A dilute lime slurry prepared in a lime slurry tank is pumped into the reaction mix cank at a controlled rate where the lime is contacted with the sludge. The overflow from the tank is held in a contact holding tank where the solids are conditioned for filtration.

F,iltration Phase The filtration is performed on a batch (cycle) basis. The filter is first precoated with diatomaceous carth using a preceat s l urry tank and trans fer pumps. Next the filter feed pumps pump the conditiuned sludge through the filter under variable flow and pressure until flow diminishes as measured in the effluent weir tank. The cake is then blown with air and discharged from the filter to storage for periodic off site disposal. The filtrate during the filter run drops from the weir tank into a collection vessel.

It is then pumped through polishing filters prior to discharge. These polishing filters also serve as emergency back-up should a filter cloth break through.

The high pH filtrate is adjusted automatically with dilute sulphuric acid prior to the final filtration. Sand filter backwash is returned to the head of the system.

Treated Effluent All the treated wastes will be flow monitored and sampled in accordance with guidelines prior to combination with another in-plant stream for discharge.

The:e plans are hereby approved subjcet, nevertheless, to th'c condition that the vaste trec.tnent plant constructed under said plans vill produce an effluent satis-factory to the Department.

By this approval, the Cc=:enwealth of Pennsylvania assures no responsibility for the feasibility of the plans or the efficiency of,

the operation of the plant to be constructed thereunder.

j This per=it is issued subject to all Rules and Regulations now in force, and the following Special Conditions:

P A.

The effluent discha-ged to the waters of the Co==onwealth shall not ba acid, shall have a pH of not less than 6.0 nor greater than 9.0, and shall not con-tain tore than 7.0 mg/l of dissolved iron.

B.

In order to avoid obsolescence of the plans of vaste treatment works, the

-.7 approval of the plans herein granted, if not specifically extended, shall cease and be null and void two years from the date of this per=it unless the works covered by said plans shall have been completed and placed in operation on or before that date.

C.

Within six months after the herein approved vaste treatment works are ' constructed and_placed in operation, the permittee ahn11 submit to the Pennsylvania Department of Environ = ental Resources, Farrisburg, Pennsylvania, evidence of the efficiency and adequacy of such works in treating the vaste discharges from this establish-(

rent. If the proposed vaste i,reatment works fail to meet the requirements of the f

Department for secondary treatment, then the permittee shall immediately proceed with the installation of such provisions as may be necessary to obtain a degree of treatment satisfactory to the Department, subject to approval by;the Depart-ment of plans for any major additions to or modifications of the new proposed vaste treatment works.

Secondary treatment is that treatment that vill reduce the organic waste load as measured by the biochenical oxygen derand test by at least 85% during the period May 1 to October 31 and by at least 75% during the remn4Mer of the year based on a five, consecutive day average of values; vil1 remove practically

all suspended solids; vill provide effective disinfection to control disease producing organisns; vill provide satisfactory disposal of sludge; and vill reduce the quantities of oil, greases, acids, alkalis, toxic, taste and odor producing substances, color, and other substances inimical to the public interest to levels that vill not pollute the receiving stream.

An equivalent of secondary treat =ent is required for nonbiedegradable vastes.

The attention of the per=ittee is diretted to the necessity of technical control and experimentation in 'the operation of the porposed vaste treatment works to D.

Approval of plans refers to vaste treatment and not structural stability, which is assumed to be sound and in accordance with good structural design. Failure, because of faulty structural design or peor construction, of the works herein approved vill render the per=it void.

G.

No matter how well designed and carefully constructed a vaste treatment works may be, full effectiveness cannot be developed unless it is efficiently cpera-ted.

In order to secure such efficiency, protect the waters of the Co==onwealth, and insure the most effective and economical dosage when chemicals are used, the permit is required to place the works under the regular charge of a responsible plant official, and its operation under the control of the designer of the works (or other qualified person approved by the Bureau of Sanitary Engineering) for at least one year after completion. Moreover, upon written notice from the Bureau of Sanitary Engineering, the permittee shall maintain one or more skilled operators regularly on duty for such daily periods as the Bureau may direct.

H.

The discharge of untreated or improperly treated industrial vastes to the waters of the Commonwealth is contrary to the requirements of the Department, If, because of accidental breakcovn of the treatment works or plant equipment or for other reason, any such discharge should occur, then the operation of the mill or process producing such discharge shall be discontinued until repairs to the treatment works or other satisfactory measures to prevent stream pollution shall t

have been completed.

I.

The following limits and conditions shall apply for the controlled release of radioactive materials in liquid effluents to the environs:

1.

The calculated annual dose above background to an individual in an unrestricted area should not exceed 3 mrem to the whole body or 10 mrem to any organ.

2.

The concentration of radioactive materials released in liquid from all reactors at the site shall not exceed the values wastst specitted in 10 CFR Part 20, Appendix B, Table II, Column 2, for unitstricted areas.

3.

The release rate of radioactiva ~ m ials in liquid wastes, excluding tritium and dissolved gases, shall not exceed 10 Ci/ reactor / calendar quarter.

4.

During the release of radioactive vastes, the effluent control monitor shall be set to alarm and to initiate the automatic closure of the waste discharge valve prior to exceeding the limits specified in 2 above.

5.

The operability of the automatic isolation valves in the liquid discharge lines shall be demonstrated annually.

When the release rate of radioactive materials in liquid wastes, excluding tritium and dissolved gases, exceeds 2.5 C1/ calendar quarter / reactor, the permittee shall nake an investigation to identify the causes for such release rates, define and initiate a program of action to reduce such release rates to the design objective levels, and report these actions to the Pa. DER within 30 days from the end of the quarter during which the release occurred.

The maximum amount of tritium released'per reactor per calendar year shall not exceed 1,000 curies.

We have evaluated the impact of defining the effluent limitations as net rather than gross, and have found that in this case there would be no sign 4fia"t impact on water quality. We therefore agree with your request, and hereby revise the above permits for Three Mile Island to reflect net limitations. Obviously, this does not apply to the 11=i-tations on pE and Temperature.

We hope that this will be sufficient to eli=inate any problems with permit co=pliance due to intake water quality.

The screenings and sludge shall be so handled that a nuisance is not created and shall be disposed of in a sanitcry manner to the satis-4 faction of the Division of Sanitary Engineering of the Department of Health.

In view of the possibility of the production of industrial weste waters containing objectionable characteistics which the treatment works herein considered may not be capable ci correction or eliminating, the said waste treatment works must be regarded as experimental and the L

production of a satisfactory effluent.

THIR'IEEN: The right to discharge the effluent frem the herein approved industrial waste treatment works into the waters of the Co==onwealth is specifically made contingent upon such operation of these works as will produce an effluent of a quality satisfactory for disgharge into the re-ceiving body of water. If, in the opinion of the Sanitary Water Board, these works are not so cperated or if by reason of change in the charac-ter of wastes or increased load upon the works, changed use or condition of the receiving body of water,' or otherwise, the said effluent ceases to be satisfactory for such discharge, then upon notice by the Board the right herein granted to discharge such effluent shall cease and becemo null and void and, within the time specified by the Board, the pemittee shall adopt such remedial measures as will produce an effluent which, in the opinion of the Board, will be satisfactory for discharge into the said receiving body of water.

EURTEEN: If at any time the industrial waste treatment works of the perdttee, or any part thereof, or the discharge of the effluent there-from, shall have created a public nuisance, or such discharge is or may become inimical and injurious to the public health or to animal or aqua-tic life or to the use of the recei7ing body of water for demestic or

, industrial consumption, or for recreation, the per=ittee shall forthwith adopt such remedial measures as the Sanitary Water Board may advise or

wastes must be suitably modified prior to their discharge thereto.

Therefore, the permittee is hereby notified that when the Sanitary Water Board shall have determined that the public intemsts require the treatment or further treatment of the industrial wastes of the pemittee, then the pemittee shall, upon cotice by the Board, within the tir.e specified, submit to the Board for its approval, plans and a report providing fcr the degree of treatment of the pemittes's indus-trial wastes specified by the Board and after approval theraof shall construct such works in accordance with the directions of the Boani.
