In our Order of August 6, 1979 scheduling a special prehearing conference (44 Fed. Reg. 47653, August 14,1979), we indicated that we would rule upon certain contentions previously submitted by Mr. and Mrs. Robert Framson, Mr. F. H. Potthoff, Dr. David Marrack, Mr. John F. Doherty and by Texas-Public Interest Research Group. The Board had hoped to rule upon these con-tentions in an exp.editious manner but we have been unable to issue such a s

ruling because the Framsons, Mr. Potthoff, and Mr. Doherty filed amended, or reamended, or new contentions which we have received subsequent to August 6th.

As indicated in our Order of June 25, 1979, contentions may be amended without prior approval of the Board, consistent with the provisions of 10 C.F.R. 5 2.714(a)(3).

1C91 347 Between April 11, 1979, the date of the issuance of our Memorandum and Order, and September 14, 1979, the Framsons, Mr. Potthoff, Mr. Doherty, as well as Dr. Marrack, Ms. Brenda McCorkle, Ms. Carro Hinderstein, Mr. Wayne Rentfro, and Tex Pirg, shall have had more than' adequate time within which to amend contentions. Accordingly, on or before September 14, 1979, the above-named individuals or organizations may file amended contentions without prior approval of the Board.

Subsequent to September 14, 1979, amended contentions may be filed, but, in order to be considered by the Board, a showing must be made of 7 910 03 0 7R Y

. good cause, if any, for failing to file on time, and the four other factors set forth in 10 C.F.R. 2.714(a)(1) must be discussed.

Further, beginning with Mr. Doherty's Contention 42 and his amendments to Contentions 15,16, 21, 38 and 39 filed on August 20, 1979, Staff and Applicant need not respond to these submissions (or to those which might be filed on or before September 14, 1979 by any of the other individuals or organizatio.s adverted to in the second paragraph hereof) until September 29, 1979.

In proceeding in this manner, the Applicant's response and the Staff's response will address all of the remaining amended contentiens of the afore-named individuals and organizations.

Finally, as an exception to the third paragraph of this Order, we rescind our Order of August 24, 1979, which had denied Stiff's Motion For Extension Of Time dated August 21, 1979, and request that, on or before September 11, 1979, Staff respond to Mr. Doherty's amendments to Contentions 12,19, 22, 29 and 33.

As indicated in our Order of August 6, 1979, the special prehearing con-ference will begin on October 15, 1979 at a time of day and place to be announced at a later time.
