MOTION TO DEFER SPECIAL PREHEARING CONFERENCE On July 10, 1979, the Licensing Board issued an order scheduling the Special

Prehearing Conference in the captioned proceeding for August 15-16, 1979.

The NRC Staff respectfully moves the Board to defer that conference for at least one month.

At present, both of the NRC Staff counsel assigned to the Carroll County Site proceeding are scheduled to participate in another hearing on the dates in question. While other Staff counsel might be made available to represent the Staff at this conference, such action would necessitate a duplication of preparatory efforts, and force a reallocation of Staff resources.

Moreover, Staff believes that the additional time could be advantageously used to attempt to negotiate contentions with Intervenors prior to such a conference.

To date, no such meetings have occurred.

Counsel for Applicant, the Attorney General of the State of Illinois, and the Attorney General of the State of Iowa indicate that they do not object to 33b259 7909120 /0 9 g

Counsel for the Daviess County Ad Hoc Comittee on Nuclear Energy Informatica, and the Icwa Public Interest Group, Inc., have indicated that such a delay.vould assist them in preparing their respective cases.*
