This refers to License Condition 9.3.59 to License SNM-368, issued on November 29, 1978, and your responses dated February 14 and July 13, 1979.
The license con-dition and your responses pertain to compensatory measures that are to be taken when a critical security system becomes inoperative.
You stated in your letters that the revisions to the Physical Piotection Fian imposed by License Condition 9.3.59 were submitted under 10 CFR 70.32(e), do not decrease the effectiveness of your existing security plan, were submitted for the convenience of the Commission, and that no fee was required for their review and approval.
We have completed our review of your submittals for license fee purposes, and have determined that they are subject to an amendment fee.
Filings under 570.32(e) are not exempt from fees unless the changes to the security plan can be made with-out Commission approval.
Your compliance with Condition 9.3.59 of License SN!1-368 requires the submission of certain procedures for NRC review and approval.
A licensee's compliance with a license condition, where NRC review and approval is required, is not exempt from fees.
While your proposed procedures may not decrease the effectiveness of your existing security plan, the procedures do require specific NRC review and approval, and are not considered as being filed for the convenience of the Commission.
Accordingly, your submission is subject to a minor safeguards amendment fee of $3,500 as specified in fee Category 1 A of Part 170, copy enclosed. Payment should be made to the U.S. Nuclear Regulatory Commission and mailed to the attention of Douglas Weiss, License Fee Management Branch.
Please note Footnotes 1(d) and 4 of Section 170.31, which provide that upon com-pletion of the licensing review, the Commission will review its expenditures for 3 3_'.'.M d
