Dear Mr. Bryden:

In my letter of June 1, 1979, NRC acknowledged receipt of your letter of April 28, 1979, related to possible material substitution for a tank at the Three Mile Island nuclear power plant.

Our investigation of the situation identified that the tank in question was, indi a fabricated of fiberglass,. rather than the originally specified "Haveg" material.

The tank is, however in a system which has no relation to nuclear safety.

Therefore NRC does not have jurisdiction.

Record keeping practices for non nuclear elements of the plant are not as rigorous as for elements under NRC jurisdiction, and we did not find a complete history of engineering decisions which ultimately resulted in replacement of the tank.

We did, however find evidence that a replacement tank was installed, and that tank, and the other associated systcm components are performing satisfactorily.

A summary of the results of our investigation is enclosed.

Thank you for your willingness to provide us with information, and for your concern about quality which might affect nuclear safety.

SUMMARY

OF THE RESULTS OF AN INVESTIGATION REGARDING POSSIBLE MATERIAL SUBSTITUTION IN A TANK AT THREE MILE ISLAND Question Is the subject tank uniquely associated with Unit 1 or Unit 2, or is it a system common to Unit 1 and 2.

What is the system with which the tank is associated.

Answer The tank is a part of the Industrial Waste Treatment System (non-radioactive) which is common to both Units 1 and 2.

Question What function does the system serve.

Answer The system is designed to collect and treat industrial waste waters from all parts cf the Three Mile Island plant, to assure that discharged waste water meets Environmental Protection Agency rules for oil and solids content.

The system is not designed to process raaicactive waste.

Question Is the tank or system defined by the licensee as " safety related"

("Q" listed)?

Answer No.

This is not defined as a safety related system.

Question Does the in place tank conform to.pecifications.

Answer Since this system was not designed or purchased to the requirements of 10 CFR 50 Appendix B, a complete documentation package was not developed.

The original system specification called out Haveg 61 for the tank.

The procurement chain is as follows.

, The owner's AE-Gilbert Associates issued an order (to furnish and install a complete system) to Passavant. Passavant procured equipment from US Filte-Corp.

US Filter suhcentracted fabrication of the tank to Chem Tanks.

The purchase documents specified Haveg 61.

The president of Chem Tanks stated to the NRC inspector that the purchase order was modified by mutual agreement to permit use of Haveg 61 or Atlac 382, that the tank was made using Atlac 382, and that certifi-cation to that effect was supplied with the tank.

Contractual modifications were handled by an individual no longer in US Filter employ.

The current spokesmen for US Filter cocid not verify or refute the information.

Discussion with Three Mile Island personnel disclosed that permanent records were not maintained on equipment of this type, but from memory, the tank was replaced without charge in late 1978, and they assumed the new tank was Haveg 61.

The US Filter spoketman stated that the original tank had not been satisfactory from the time of initial installation in 1976.

After finding that repairs would cost nearly as much as a ne tank, US Filter replaced the original tank with a new one, also of Atiac 382.

Three Mile Island representatives state that the replacement tank is performing acceptable.
