Dear Mr. Bean:

This is in reply to your letter to the Nuclear Regulatory Commission Shutdown of on the closing of the Maine Yankee nuclear power plant.

this plisnt was ordered by the NRC on March 13, 1979, because of questions about the ability of the piping system t withstand earthquakes. Enclosed are maps showing the' location and intens1q of earthquakes that have occurred in Maine and Northern New England. Another earthquake took place about six miles west of Maine Yankee on April 17, 1979. This was felt in the control room of Maine Yankee, but there was no apparent damage to the plant.

Our objective is to review the situation in an expedited and disciplined manner so that the plant can be returned to operation with assurance that We are this will not constitute a threat to the public health and safety.

mindful of the economic hardships that can occur as a result of plant shutdowns and are working as hard as we can to avoid any unnecessary de.ays in bringing the plant back on line.

OLYMPIA SNOWE FROM: CUMBERLAND COUNTY RF B ICAN COMMITTEE JOSEPH BEAN, CHAIRMAN AT THE MOST RECENT MEETING OF THE CUMBEPLAND COUNTY REPUBLICAN COMMITTEE THE MEMBERS DISCUSSED AT LENGTH THE INCREDIBLE FINANCIAL BURDDI THE CLOSING OF MAINE YANKEE WILL PUT ON MAINE CONSUMERS DUE TO EVER RISING OIL PRICES.

IT MUST BE RDIEMBERED THAT MAINE IS NOW CONSIDERED THE POOREST STATE IN THE NATION YET WE ARE POTENTIALLY SUBJECT TO THE HIGHEST COSTS IN THE NATION FOR FUEL OIL IF MAINE YANKEE IS CLOSED.

ALTHOUGH YOU ARE BOUND TO ENFORCE NUCLEAR POWER REGULATIONS, IT IS OUR HOPE THAT YOU WILL WORK WITH CONGRESS IN RECONSIDERING YOUR RECENT DECI-SION.

IT IS OUR UNDERSTANDING THAT YOU ALONE CANNOT WAIVE REGULATIONS. HOWEVER, GIVEN THE RDiOTE POSSIBILITIES OF EARTHQUAKE ACTIVITY AND SIMULTANEOUS FAILURE OF THE PLANT'S SECONDARY COOLING SYSTEM AND CONSIDERING MAINE'S FUEL OIL PROBLDiS, WE BELIEVE THAT THE COMMISSION SHOULD EXERCISE SOME PLAIN "DOWNEAST" COMMON SENSE.

THE FOLLOWING IS THE COMMITTEE'S RESOLUTION:

BE IT RESOLVED THAT WE ENCOURAGE THE FEDERAL GOVERNMENT AND THE NUCLEAR REGULATORY COMMISSION TO RECONSIDER THE CLOSING OF THE MAINE YANKEE NU-CLEAR POWER FACILITY UNTIL THE CURRENT FUEL OIL CRISIS IS RESOLVED.

WE BELIEVE PAST EVIDENCE OF EARTHQUAKE ACTIVITY IN MAINE DOES NOT WARRANT THIS_ CLOSURE PARTICULARLY IN LIGHT OF THE CURRENT FUEL OIL SHORTAGE AND

, SUBSEQUENT HIGH PRICES.

AS A FOOTNOTE, YOU SHOULD ALSO BE AWARE THAT OUR STATE PARTY ORGANIZATION, WHICH WE SUPPORT, IS CALLING FOR A MORATORIUM ON FURTHER CONSTRUCTION OF NUCLEAR POWER FACILITIES UNTIL THE PROBLEM OF RADIOACTIVE WASTE DIS-POSAL IS SATISFACTORILY RESOLVED.

LET US HOPE THAT EVERY EFTORT IS BEING MADE TOWARD THE DEVELOPMENT OF SAFE, PLENTIFUL, AND RENEWABLE ENERGY RESOURCES.
