Dear Mr. Allen:
We are in receipt of your letter of October.15,1979, asking for advice regarding the availability of scope of wprk for your proposed waste disposal project.
There are several questions raised by your letter which we feel you should pursue. They are:
1.
Is the South Central Kansas Economic Development District (SCKEDD) a private concern operating for profit or is it a non-profit organization?
2.
Whose work are they bidding on, applicants or State? Are they going to prepare an environmental report for the applicant or an environmental assessment and report for the State?
3.
Does the SCKEDD have the expertise and necessary disciplines to perform an environmental assessment for this project?
If it is determined that the SCKEDD is bidding on work for the applicant to prepare an environmental report on the project which will be submitted to the State as part of the application, your concern then is to be sure that their input properly and accurately addresses all of the necessary environmental concerns. However, if they are bidding on work for the State, that is to participate in the State's. environmental assessment and preparation of the State's environmental impact statement, you will want to know their credentials and expertise for the scope of work, and to inform them exactly what they are to do.
If the latter is the case, and should they be awarded the contract, then the SCKEDD will be acting as a consultant to the State and they should be brought into the cooperative effort being conducted by your office, NRC, and MSHA. Additionally, their role should be clearly defined.
