This is in reply to your note of August 8,1979, to which you attached a 8
letter fron your constituent, Mrs. Helen Padula, dated August 6,1979.
Since 1973, the.1uclear Regulatory Comission (NRC) has been actively re-viewing 2n application by Offsbore Power Systems (OPS), a subsidiary of
'Jestinghouse Electric Corporation, to nanufacture up to eight identical floating nuclear power plants (F.?iPs).
If the applicaticn is approved, the plaats would be constructed using assembly line techniques at a shipyard facility at Blount Island in Jacksonville, Florida.
The NRC has not made a final decision regarding the granting of a manufacturing license to OPS, although the NRC staff recommended issuance, subject to specific ccaditions to protect the environment, in a three-part l
Final Environmental Statement (enclosure 1). - The Comission will not take any action on granting the license until: a) The flRC safety review is completed and Supplement No. 3 to the staff's Safety Evaluation Report

is issued, b) the Atomic Safety and Licensing Board authorizes the issuance of the license following the closing of environmental and safety license hearings, and c) thet Advisory Comittee on Reactor Safeguards makes a finding regarding the' safety of the proposed FNP design. The' staff anticipates that its safety review will be completed an6 Supplement tio. 3 to the Safety Report will be issued late in 1979. It is expected that a 'ditional oublic hearings will be scheduled during 1979 and 1980.
With this schedule, we expect a Commission decision or. the issuance of a manufacturing license in mid-1980.
If the Atomic Safety and Licensing Board should acthorize the issuance of a manufacturing license to OPS,'and if anparty to that proceeding desires to challenge the Licensing Board's initial decision, that party may file exceptions to the decision and request cral argument before an Atomic Safety and Licensing Appeal Board panel. That Board w'ould consider the safety or environmental issues raised on appeal and rbnder a decision with regard to those issues. The Appeal Board's decision may then be challenged before the !!RC Comissioners and ultimately in the Courts.

I Your constituent's concern regarding the capability of the FilP to withstand the hazards of the sea environment is well taken, h'e believe the staff has adequately addressed this issue in its Safety Evaluation Report and supplements (enclosure 2).
I This report includes a listing of plant site desig.' parameters (See Table 1.2 of Supplement 2 to the Safety Evaluation Report) which define
' specific siting requirements to ensure that an FNP would not be exposed to conditions for which it was not designed. Each FNP would be designed 4
and sited so that it could be maintained in a safe condition when exposed i
to severe environmental phenomena such as tsunamis, storm surges, hurricanes, to nadoes and icing. Based'upon the review to date, the staff has_found that an FNP could be operated safely in the sea environment.

. issued, subject to certain cond;jions, the' ommission itself has not formally reached any decision re arding th granting of such a license.
to OPS. The bases for the staf recommend ion'are. presented in the Safety Evaluation Report and it two suppli ments and a separate three-part Final Environmental Impac Statement.
These documents together with supplemental staff testimony have been pre sented before an Atomic Safety
'and Licensing coard during public hearings on the OPS application. These hearings were held during varibus times from 1975 throuqh 1979 and remain open, although all contentiond related to hafety and environmental issues have been heard before the Lidensing Board, The Commission cannot take any action on the issuance offthis license to OPS until: a) Supplemen't l!o. 3 to the Safety Evaluation Report is issued, b) the hearings are closed,-
c) the Licensing Board authorizes the issuc nce of such a license, d) the Advisory Committee on Reactor Safeguards makes a finding regarding the ment t!o. 3 to the Safety Report will be is) sued late in 1979 and that safety of the proposed FitP depign. At this juncture, we believe that a decision on the issuance of a manufacturing license would probably not-be forthcoming until mid-1980.
