NRC STAFF'S RESPONSE TO LICENSEJ'S MOTION FOR CLARIFICATION OF TIME FOR RESPONSE TO MOTION FOR
SUMMARY
DISPOSITION On September 27, 1979, the Licensee in the captioned proceeding filed a " Motion for Clarification of Time for Response to Motion for Summary Disposition."
Therein, the Licensee seeks an explicit confirmation that responses to its motion for summary disposition of specified contentions, filed on August 27, 1979, are due for filing within 14 days after service of the Staff's Safety Evaluation Report (SER). Since the Staff had previously committed, in a letter to the Licensing Board dated September 21, 1979, to file its responses to the summary disposition motion shortly after issuance of the SER and, in any event, within 14 days after issuance of the SER, the Staff has no objection to the Licensee's motion for clarification.
