NUCLEAR REGULATORY COMMISSION REGION I o, h y '[/.- [E 631 PARK AVENUE KING OF PRUSSIA, PENNSYLVANIA 19406 SEP 14 M9 Town of Norton Board of Selectmen ATTN:

Mr. Raymond H. Patenande Chairman Town Hall Norton, Massachusetts 02766

Dear Mr. Patenande:

This letter is partially in response to your letter to me dated July 10, 1979, but also serves to bring matters up to date since our last meeting on June 10, 1979 with regard to the radioactive material in the privately owned landfill.

In accordance with your request, the property directly across the road from the Shpack property was surveyed for radioactive material by Mr. J. P.

Stohr and Mr. J. Kottan of this office on July 23, 1979.

They were accom-panied by Mr. G. Swibble of the Commonwealth of Massachusetts and Mr. J.

Grimaldi and Mr. D. Opatha of the Town of Norton.

Their survey indicated no radioactive material on this property.

The NRC results of the water samples taken on June 14, 1979 are enclosed as an attachment.

These results are the same as previously communicated with the exception that gross beta values are included as well as gross alpha.

These results are well within the EPA Drinking Water Standards and are in general agreement with our previous sample results.

Communications with the Commonwealth of Massachusetts indicate their preliminary results for the June 14, 1979 samples are in agreement with ours.

During our June 14, 1979 meeting we had indicated the possibility of our doing additional sampling (" coring") using USGS assistance during mid-July, 1979.

USGS has informed us that they would not be able to provide this assistance until December,1979 at the earliest.

As discussed in the meeting between you, Mr. Stohr of this office and Mr. R. Ramsey of DOE on July 24, DOE plans to initiate a similiar samplina program in September, 1979 in accord with their apparent acceptance o# federal jurisdiction and responsibility for this site.

Therefore, tF J does not plan to pursue further the previously mentioned sampling u.n9 USGS assistance.

I expect that most of your future communication with regard to federal agency actions at the lanc*ill will be directed to Mr. Ramsey and his staff at DOE; however, if there are matters in which you feel that this Offico may be of particular assistance, please do not hesitate to call.

Sincerely, 0
