Dear Ms. Rigert:
This is in response to your letter of September 24, 1979, requesting informa-tion on NRC's environcental statement process. In accordance with the NRC's regulations in 10 CFR Part 51 and the National Environmental Policy Act of 1969 (NEPA), a Draft and Final Environmental Statement (DES and FES) are prepared and made publicly available before any construction permit or operating license for a nuclear power reactor can be issued. Enclosed is a copy of a recent DES. If you read the " Foreword" on pages xii and xiii, you will find an explanation of NEPA requirements. When an FES is issued, it is sent to the Environmental Protection Agency, and to appropriate federal, state, and local officials as well as to anyone from the general public who commented on the DES or requested the FES. The FES is also sent to the applicant and all parties to the proceeding. To date there have been about 140 FES's issued by this office. The environmental statement is entered into evidence in the evidentiary hearing process which precedes construction permit or operating license issuance. I an enclosing information on the " Licensing of Nuclear Power Reactors" wtyich explains this process and explains the use of the FES.
