Dear Mr. Bowers:

This is in response to your Petition for Rulemaking of August 7,1979, on behalf of the Anti-Nuclear Group Representing York (ANGRY).

In the petition, pursuant to 10 CFR 52.802, ANGRY requests that the Commission, in conducting hearings on the restart of Three Mile Island, Unit No.1, determine if the licensee, Metropolitan Edison Company, has failed in its operation of Three Mile Island, Unit No.1, to act ir. accordance with the terms of the Atomic Energy Act of 1954, as amended (42 U.S.C. 2011 et seq), the regulations of the Commission (10 CFR 150.100), and the applicable operating licensee (Facility Operating License No. DPR-50).

Although the petition filed by ANGRY fails to meet the requirements for a petition for rulemaking under 10 CFR 52.802, I note that on August 29, 1979, ANGRY filed a petition to intervene in the hearings to be held on the restart of Three Mile Island, Unit No.1.

Since the issues to be considered at the hearings appear to be similar to those you raise in your request, I assume you will address your concerns to that forum.
