License Fee for Maine Yankee Proposed Change No. 70 The purpose of this letter is to forward to you a check in the amount of $8,300.00 for the licensing review of Proposed Change No. 70.
This change relates to a modification of the existing spent fuel storcge capability. The original submittal was mailed on September 18, 1979 with a check in the amount of $4000.00. The total payments to date for this licensing review is $12,300.00.
Maine Yankee Atomic Power Company believes that the NRC revised fee schedule is illegal. We are aware that an appeal of the decision of the United States Court of Appeals for the Fifth Circuit is being considered and therefore submit the enclosed fee under protest without waiving our right to contest the validity of this fee or the entire NRC fee schedule, and without waiving any right to recover, in whole or in part, all fees paid or to be paid under the invalid fee schedule.
This additional fee was requested in a letter from your staff on October 5,1979, Reference (b).
