j j.e, g NRC STAFF'S RESPONSE TO AMENDMENTS TO NEW CONTENTIONS I & II FILED BY F. H. POTTHOFF, III On May 25, 1979, Mr. Potthoff filed, inter alia, contantions dealing with tornado missiles and possible disabling of the ECCS at Allens Creek. The Staff responded to these contentions in a pleading dated June 11, 1979, urging tnat both contentions be denied. Mr. Potthoff has ncw filed a document entitled " Amendments to New Contentions I & II," which is undated but docketed by the Corrmission on August 2,1979. For the reasons discussed below, the Staff continues to believe that both contentions should be rejected by this Board.

CONTENTION I Mr. Potthoff alleges that the Applicant does not meet the Reg Guide 1.76 design basis tornado criteria of 290 mph translational speed and 70 mph rotational speed.

He states that the Applicant's PSAR indicates that the facility will be designed to cope with a tornado having translational and rotational speeds of 300 mph and 60 mph, respectively. However, Mr. Potthoff has obviously not reviewed 1029 196 7 9o9280 C29 g

. Amendments 30 (Appendis C) and Amendment 48 (p. 3.3-3). of the PSAR, which indicate that tMe facility will be designed to the Reg Guide 1.76 criteria.

There is, therefore, no litigable issue presented by this portion of the contention.

Mr. Potthff goes on to allege that a. tornado may destroy all electrical transfonners and affect safety-related equipment. However, he has provided no basis for believing that such an event is a reasonable possit'.lity.

Indeed, the Staff requires (Reg Guide 1.117, " Tornado Design Classificaticn't that all Class lE electrical systems (including the auxiliary systems for onsite emergency power supplies that provide emergency power for essential safety systems) be designed to withstand the effects of the design basis tornado established under Reg Guide 1.76, supra. The building housina the emergency diesel generators is a Category 1 structure (SER, Section 8.3.1) all of which are designed to cope with missiles generated by the design bapis tornado.S Therefore, it is clear that generators'which supply emergency power to essential safety systems are designed to withstand the most damaging of missiles generated by the design basis tornado. -3, themselves hurled at the plant does not aid him at all, since he provides no basis to believe that essential safety systems of the plant are not adequately protected againct such an event. As a result, there is absolutely no basis for Mr. Potthoff's suggestion that the plant must be placed underground in order to be protected from missiles generated by the design basis tornado.

CONTENTION II Mr. Potthoff alleges that "unless ACNGS is buried as suggested in Contention I, it should have a backup system for the ECCS operated by air pressure, hydraulic means, or mechanically."

It is utterly impossible to discern the reason why Mr. Potthoff would impose additional requirements relating to the ECCS at Allens Creek; this contention is devoid of the statement of basis required by 10 CFR 62.714.

In addition, as the Staff indicated in its response to this contention in Mr. Potthoff's May 25, 1979 pleading, 10 CFR 550.46 and Appendix K to Part 50 govern the reliability criteria for the ECCS. To suggest that anything further is required constitutes a challenge to the regulations which may not be entertained by this Board absent a showirg (not made here) of special circumstances pursuant to 10 CFR 52.758.

CONCLUSION For the reasons stated above, the Staff continues to believe that neither Contention I nor Contention II meets the requirements of 10 CFR 52.714 and that they should be rejected as issues in controversy.
