cp ORDER OF JULY 25, 1979 The Comission has before it petitic.1s for a hearing with respect to the proposal of the Northern Indiana Public Se'.vice Company (NIPSCO) to use shorter pilings than originally contemplatea for the foundations of the Bailly Generating Station, Nuclear-1. The NRC Staff and NIPSCO have previously filed exte[1sive responses to questions of the Comission relating to the petitions.
The Comission requested that the Advisory Comittee on Reactor Safeguards (ACRS) address the significance of the use of the shorter pilings. By letter of July 16, 1979, the ACRS reported its belief that:

The use of shorter piling is not a significant design change from the standpoint of engineering.
2.
The use of shorter piling would not reouire significant alteration of other aspects of the design of the facility.
3.
There will be no difference in the safety of the facility depending on whether longer or shorter pilings are used if (certain referenced] matters are treated as now proposed.
The Comittee report was prepared after public meetings of a subcomittee and of the full comittee at which presentations of the Staff, the Applicant, and 7 9002 50l47 1,030

, the Applicant's consultants were considered.
In addition, members of the public (including representatives of some of the petitioners) presented statements at the subcommittee meeting which was held in the vicinity of the Bailly site.
The issues raised in these statements were considered by the full committee.
On July 25, 1979, the Commission invited all parties to coment on the ACRS letter.
The Staff is in agreement with the conclusions of the ACRS, and believes that its letter is consistent with the Staff's position that the proposal to use shorter pilings does not involve a departure from the principal architectural and engineering criteria for the design of the facility described in the appli-cation. Accordingly, the Staff continues to believe that the licensee's proposal to use shorter pilings should not be treated as a request for a construction permit amendment.
