Dear Mr. Buckley:
This is in further response to your letter dated August 1,1979 in which you requested, pursuant to the Freedom of Information Act, copies of all records from January 1,1976 to the present relating to: 1) Westinghouse Electric Corporation export license application No. XR-120 (11/18/76),
No. XCOM-0013 (8/3/78), and No. XSNM-1471 (3/6/79); 2) all records from January 1,1976 to the present relating to proce.dures for applications and policies for export licenses for facilities, components, or nuclear power plant fuel; and 3) all records from January 1.1976 to the present relating to the Philippine Power Reactor Project.
Documents 1 through 29 and portions of document 30 of Appendix A are being placed in the NRC Public Document Room,1717 H Street, N.W.,
Washington, DC for your inspection and copying.
Documents 1, 7, 8, and 9 of Appendix B are predecisional in that they discuss matters pertaining to a license application under consideration by the Commission.
Documents 2 through 6 of Aapendix B contain advice, opinions, and recommendations of the staff.
Partions of document 30 of Appendix A are predecisional for the reason just s tated, and also contain advice, opinions, and recommendations of the staff.
These documents are being withheld from public disclosure pursuant to Exemption (5) of the Freedom of Information Act (5 U.S.C. 552(b)(5)) and 10 CFR 9.5(a)(5).
Document 9 of Appendix B has been classified pursuant to Executive Order 12065 and is predecisional for the reason stated in the paragraph above.
This document is being withheld from public disclosure pursuant to Exemptions (1) and (5) of the Freedom of Information Act (5 U.S.C.
552(b)(1) and (5)) and 10 CFR 9.5(a)(1) and (5).
Pursuant to 10 CFR 9.15 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure and that its production or disclosure is contrary to the public interest.
The pcrson responsible for the denial of portions of document 30 of Appendix A is Al Kenneke, Acting Director, Office of Policy Evaluation.
The person responsible for the denial of documents 1 through 9 of Appendix B is Samuel J. Chilk, Secretary of the Commission.
