Dear Mr. Cochran:
This is in response to your letter dated July 6,1979, in which you requested, pursuant to the Freedom of Information Act, all documents generated or utilized by the Task Force on Safeguards Policy and any subsequent information developed by the NRC pertaining to recommendations of the Task Force.
You agreed in a telephone conversation on July 18, 1979 with Ms. Carol Ann Reed of my staff to an extension of ten working days for NRC's response.
Documents 1 through 5 of Appendix A are located in the NRC Public Document Room (PDR) at 1717 H Street, N.W., Washington, D.C.
Documents 6 through 14 of Appendix A are being placed in the PDR.
The enclosure to document 1 of Appendix B is a draf t (February 8,1979) of the Report by the Task Force on NRC Safeguards Policy.
The document reflects the Task Force's advice, conclusion, deliberations, opinions and recommendations and is being withheld from public disclosure pursuant to Exemption (5) of the Freedom of Information Act (5 U.S.C. 552(b)(5))
and 10 CFR 9.5(a)(5) of the Commission's regulations.
The non-exempt cover memo of this document is being placed in the PDR.
Pursuant to 10 CFR 9.9 of the Commission's regulations, it has been determined that the information withheld is exempt from production or disclosure and that its production or disclosure is contrary to the public interest. The persons responsible for this denial are the under-signed and Mr. William J. Dircks, Director, Office of Nuclear l'aterial Safety and Safeguards.
This denial may be appealed to the Commission's Executive Director for Operations within 30 days from the receipt of this letter.
As provided in 10 CFR 9.11, any such appeal must be in writing, addressed to the Executive Director for Operations, U.S. Nuclear Regulatory Commiss'on, Washington, DC 20555 and should clearly state on the envelope and in 'he letter that it is an " Appeal from an Initial FOIA Decision."
