Licensing Board Notification Regarding ISP Letter E-55041
Dear Administrative Judges:
In accordance with its obligation to inform the Licensing Board of relevant developments,1 Interim Storage Partners LLC (ISP) hereby notifies the Board and the parties that, on September 4, 2019, it submitted, to the U.S. Nuclear Regulatory Commission (NRC) Staff, ISP Letter E-55041. That Letter provides supplemental information regarding ISP Environmental Report (ER) Chapter 3, Description of the Affected Environment. Specifically, ER Section 3.5.16 refers to six prior ecological studies, listed in five bullets, of the proposed Consolidated Interim Storage Facility area and nearby areas that are referenced or described in ER Section 3.5. ISP Letter E-55041 transmits electronic copies of, or provides ADAMS accession numbers for, those studies (six reports in total, as there are two reports for the National Enrichment Facility).
The above-referenced Letter and its Enclosures are attached. The Board and parties may view those documents as relevant to Sierra Club Contention 13, the only contention admitted by the Board in its August 23, 2019 Memorandum and Order (LBP-19-7) ruling on intervention petitions and requests for hearing. The Board admitted Sierra Club Contention 13 solely as a contention of omission, insofar as none of the five references in section 3.5.16 of ISPs [ER] is either sufficiently described to judge its technical adequacy or made publicly available. LBP-19-7, slip op. at 56. As noted above, ISP Letter E-55041 provides copies of, or public links to, the Section 3.5.16 references in question.
