Recent inspections b NRC have identified frequent ccncocpliance with n cns-portatien regulations by radiography licensees. As of Dece ber 3, 1979, tre NRC inspection progra: has included inspection / enforcement of CG regulaucus in -9 CFR 170-175 as direct NRC require =ents (see 10 CFR 71.5)

Ristorically, this has caused some confusien en the part of radiography users, particularly with respect to sorting out the transpcrt regulatory requirements of 49 CFR/10 CFR 71 free the cperational requirements of 10 CFR 30 and the specific license which has been issued to the radiography user.

Another source of confusien for the radiography operatcr is that he most frequently functions, with respect to the transportatic:

regulations, in the dual role of both shipper and carrier.

  • his notice discusses seme of the pertinent transportation requirements for radiography devices when used as transport " packages." The explanations should help to clarify the application of operational licensing requirerents versus transport requirements applicable to shippers and carriers, thereby enhancing regulatory corpliance with the requirements.

requirements of "special form" as defined in 69 CFR 173.3S9(g) and 173.395(a).

Radiography transporters are reminded that these requirements call for each shipper of a special form source to maintain a file of supporting safety analysis or documentatica containing the results of the testing perforced on the source to demonstrate that it meets the special for= requirements.

This does not mean that each shipper has to actually perfor= the tests, only that Ad-5f" WW q: the tests.
