WASHINGTON, D. C. 20555 a

";gyuiff gv j JUL 5 1979 llocket No. 50-322 Mr. Wm. H. Rogers, Clerk Office of the County Legislature County Center Riverhead, New York 11901

Dear Mr. Rogers:

Your letter dated June 6,1979, addressed to Chaiman Hendrie, has been referred to me fcr reply since the decisions and rulings promulgated.by the Atomic S;iety and Licensing Boards regarding licensing proceedings are subject to review by the Chaiman and the Ccenissioners. Accordingly, it would be inappropriate for Chaiman Hendrie to respond to inquiries regarding matters pertinent to the record of the Shoreham proceeding.

Enclosed with your letter was a certified copy of Resolution No. 490 adopted by the County Legislature of Suffolk County at a May 22, 1979 meeting. The resolution requests that the Nuclear Regulatory Comissicn (NRC) require the Long Island Lighting Company (LILCO) "to conduct and complete a study of the feasibility and cost of converting the Shoreham. Electric Power Generating Station (sic. from nuclear to conventional or alternative fuel sources."

However, subsequent to receiving your letter, the NRC has received " APPLICANT'S REPLY TO MR. LIKE'S LETTER ~0' JUNE 6, 1979" dated June 21, 1979 where LILCO states the following:

"LILCO is presently analyzing the feasibility and cost of converting Shoreham frca nuclear to coal generation. The Company will be happy to make its findings available to the Legislature."

Since LILCO has stated, on tne record, that it is already conducting a study of the type proposed by the Legislature, the NRC assumes that the Legislature will accept LILCO's offer to make the findings of its study
